【正文】 合同規(guī)定的加工量，按月提供足夠數(shù)量的原輔材料和包裝物料。除因人力不可抗拒之原因外，乙方來(lái)料不足，造成甲方工廠每月生產(chǎn)不足二十一天半，停工天數(shù)累計(jì)不得超過(guò)四天，否則，乙方應(yīng)按在廠工人以停工天數(shù)計(jì)，每人每天補(bǔ)助生活費(fèi)十五元港元，支付給甲方工廠。如非人力不可抗拒原因，甲方不按時(shí)、按質(zhì)、按量交貨，造成乙方的經(jīng)濟(jì)損失，甲方應(yīng)負(fù)賠償之責(zé)任，賠償數(shù)額可在具體合同中訂明。甲方工廠加工后的成品，在甲方工廠經(jīng)乙方驗(yàn)收起運(yùn)后，甲方不負(fù)產(chǎn)品規(guī)格、質(zhì)量、短缺等任何責(zé)任。乙方超過(guò)五天仍未付款給甲方，則按逾期天數(shù)，以當(dāng)時(shí)香港*行利息一并付給甲方。 七、勞動(dòng)保護(hù)及運(yùn)輸與保險(xiǎn) 工廠應(yīng)做好勞動(dòng)保護(hù)及安全工作，完善防塵、防煙、防毒設(shè)施，廠房保持通風(fēng)光亮，內(nèi)外環(huán)境衛(wèi)生整潔，對(duì)有污染性項(xiàng)目，須經(jīng)市環(huán)保部門批準(zhǔn)，方能立項(xiàng)經(jīng)營(yíng)。 原輔材料、包裝物料的運(yùn)進(jìn)，成品運(yùn)出及加工期間存放的機(jī)械設(shè)備、原料和包裝物料及操作機(jī)械的工人，均由乙方向中國(guó)人民保險(xiǎn)公司深圳分*司投保。從試產(chǎn)期開(kāi)始，乙方應(yīng)派出技術(shù)人員對(duì)甲方工廠進(jìn)行技術(shù)培訓(xùn)，直到工人能基本掌握生產(chǎn)技術(shù)，進(jìn)行正常生產(chǎn)時(shí)為止。 九、合同期限 本合同經(jīng)批準(zhǔn)雙方簽字后，乙方須出示商業(yè)登記及銀行資信證明書(shū)交由甲方辦理營(yíng)業(yè)執(zhí)照經(jīng)海關(guān)備案生效。如要提前終止或延長(zhǎng)本合同，需在三個(gè)月前通知對(duì)方，并經(jīng)雙方協(xié)商處理終止或延長(zhǎng)合同事宜。補(bǔ)償?shù)霓k法，應(yīng)根據(jù)終止合同前半年內(nèi)的每月平均工繳費(fèi)為準(zhǔn)，補(bǔ)償兩個(gè)月的工繳費(fèi)總額給對(duì)方。雙方同意，在本合同經(jīng)批準(zhǔn)雙方簽約十天內(nèi)，由乙方預(yù)付4000港元給甲方，作為履約保證金，從甲方收到履約金之日起兩個(gè)月內(nèi)，乙方仍不投產(chǎn)開(kāi)業(yè)，履約保證金即無(wú)條件歸甲方所有，同時(shí)，甲方有權(quán)廢約。 by both parties and specified in separate contracts. 5. shipment of raw materials finished products every month, party b shall providesufficient raw materialsand packaging materialsaccording to the contracted processingvolume. toensure the normal production of party a’s plant ,partyb shall ship such materials to the plant seven days before theproductionof each lot of products. except for reason of force majeure,the plant shall operate for more than 21. 5 days. in caseproductionis held up for more than four days due to insufficientsupplyof raw materials, party b shall calculate the actual dayswhenproduction is shut down and pay to party a the workers’livingexpenses at the rate of hk $ 15. 00 per person per day. to ensure the normal operation of partyb’s business activities, party a shall deliver thefinished products to party b in accordance with thetime of delivery, quality and quantity. except for reason of force majeure,in case losses to party b are causeddue to party a’sfailure to make delivery as mentioned above,party ashall be responsible for the pensation. details ofsuchpensation shall be mutually agreed upon in separatecontracts. both pa
