【正文】 This Contract takes effect as of the date it is approved by the State Administration of Radio, Film and Television of the People’s Republic of China. 第三十一條 本合同的解釋 of Contract 本合同的內(nèi)容及條款由甲方外籍人員管理部門解釋。兩份文本具有同等法律效力。 The laws of China are applicable to all procedures and relevant laws governing the enforcement, consultation, dispute resolution in relation to this Contract and its appendixes. 本合同及附件條款及內(nèi)容如與國(guó)家法律、法規(guī)相抵觸時(shí)，以國(guó)家法律、法規(guī)為準(zhǔn)。協(xié)商不能解決的，由爭(zhēng)議一方向人事爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。 Notices can be served by fax, facetoface delivery, mail and public notice. Notice served by fax will be considered received on the same day it is sent. Notice served facetoface is considered received at the time the recipient signs the receipt. Notice served by express mail is considered received at the time the recipient signs the receipt. Notice served by telegraph will be considered received on the third day starting the day the telegraph is sent. Notice served by public notice will be considered received on the second day it is published. 由于通知發(fā)出一方的原因造成通知發(fā)出的地址或者傳真號(hào)碼錯(cuò)誤，導(dǎo)致通知不能送達(dá)或者延遲送達(dá)的，以通知發(fā)出方更正地址或者傳真號(hào)碼并重新進(jìn)行送達(dá)之日開始計(jì)算送達(dá)期限。電報(bào)方式送達(dá)通知的，以電報(bào)發(fā)出之日起第 3 日為送達(dá)時(shí)間。 以當(dāng)面送達(dá)的，以簽字收取時(shí)間為送達(dá)時(shí)間。 During the enforcement of this Contract, any matter regarding the Contract’s enforcement, amendment, cancellation, termination as well as obligation exemption and recourse should be notified by written notice, including but not limited to fax, document, agreement, regular mail, registered mail, express mail, telegraph and public notice. 通知可以傳真、當(dāng)面送達(dá)、郵寄送達(dá)、公告送達(dá)的形式進(jìn)行送達(dá)。沒(méi)有履行通知義務(wù)的，對(duì)方向本合同列明的單位地址或永久通訊地址送達(dá)文件視為通知已經(jīng)送達(dá)。 In the event that Party A cancels the Contract in accordance with of this Contract, it should pay severance pay to Party B in accordance with relevant regulations of the central government and the municipal government of the city of Chongqing. The severance pay should be based on the number of consecutive years Party B works with Party A and Party B’s average monthly wage for the 12 months prior to the termination of this Contract (If the monthly wage of Party B is greater than three times the average monthly wage of employees in Party A’s city as announced by local labor departments, the rate for the severance pay paid to Party B shall be three times the average monthly wage of employees) at the rate of one month’s wage for each full year(12 months) worked. Any period of less than one year but longer than six months shall be counted as one year. Half a month’s wage in severance payment should be paid to Party B if the period is less than six months. The severance pay should not exceed 12 months’ wages of Party B, unless the law says otherwise. 甲方未按照本合同約定向乙方提供聘用條件、 支付聘用報(bào)酬的，應(yīng)當(dāng)依照國(guó)家和重慶市規(guī)定承擔(dān)賠償責(zé)任。 補(bǔ)償金以乙方在甲方的連續(xù)工作年限和乙方離職前十二個(gè)月平均工資為基礎(chǔ) （超過(guò)政府部門公布的本市職工平均工資三倍的按三倍計(jì)算） ，按照每滿一年（十二個(gè)自然月）支付一個(gè)月平均工資的標(biāo)準(zhǔn)給付，超過(guò)六個(gè)月不滿一年的按照一年計(jì)算，不滿六個(gè)月的支付半月工資。 Party B should be liable to pensate the economic losses incurred on Party A due to Party B’s failure to fulfill its other obligations stipulated in the Contract. 乙方違約提前解除合同， 則甲方不支付本合同年的任何交通費(fèi)用補(bǔ)貼；若甲方已經(jīng)為乙方來(lái)華赴任提供了機(jī)票，則乙方須退回機(jī)票款；甲方不出具推薦信。 Party B should pay Party A 1,000 US dollars in pensation if Party B cancels the Contract or leaves the post between four and eight months after the end of probation. 乙方在離合同期屆滿 2 個(gè)月內(nèi)向甲方提出解除合同或擅自離職的，乙方應(yīng)當(dāng)向甲方支付 500 美元違約金 Party B should pay Party A 500 US dollars in pensation if Party B cancels the Contract or leaves the post within 2 months before the Contract expires. 乙方違反保守商業(yè)秘密事項(xiàng)給甲方造成經(jīng)濟(jì)損失的， 應(yīng)當(dāng)承擔(dān)賠償責(zé)任。 In the event of the Contract terminating upon expiration, neither party shall be liable for breach of Contract and pensation. 24. 乙方在試用期結(jié)束后工作已滿 1 個(gè)月未滿 4 個(gè)月期間向甲方提出解除合同或擅自離職的，乙方應(yīng)當(dāng)向甲方支付 1500 美元違約金。 Any act that results in the inappropriate, untimely and inplete fulfillment of all or part of the obligations stipulated in the Contract constitutes breach of Contract and the responsible party should be held liable for the breach. 關(guān)于違反合同的任何違約責(zé)任， 合同雙方同意違約方應(yīng)向守約方按國(guó)家有關(guān)法規(guī)賠償經(jīng)濟(jì)損失。If Party B intends to extend the Contract, he should submit an application for the extension to Party A at least 90 days before the Contract expires. If both Parties agree, they can carry out the procedures to extend the Contract. 第二十二條 本合同續(xù)訂期限 of renewed Contract 本合同續(xù)訂期限原則上不少于本合同期限，雙方另有約定除外。甲、乙雙方同意續(xù)訂本合同的，應(yīng)當(dāng)在本合同期限屆滿前簽訂書面協(xié)議。甲方要求乙方繼續(xù)工作而乙方未工作的，甲方可以不支付乙方工資。 Party B is a female employee in her pregnancy, confinement or nursing period. 在本合同約定的解除合同通知期內(nèi)， 甲方有權(quán)要求乙方繼續(xù)工作，乙方應(yīng)當(dāng)按照本合同約定和甲方的要求完成甲方安排的工作。Party B has contracted an illness or sustained a nonworkrelated injury, and the set period of medical care has not expired。 Party B has been confirmed as having lost or partially lost his capacity to work due to an occupational disease Contracted or a workrelated injury sustained with Party A。 If Party B cancels the Contract according to and has caused economic losses to Party A, Party B should pay pensation to Party A。 。 經(jīng)甲方批準(zhǔn)后，乙方應(yīng)當(dāng)按照甲方規(guī)定辦理離職交接手續(xù)并結(jié)清有關(guān)費(fèi)用、違約金。 A major change in the objective circumstances relied upon at the time of conclusion of the Contract renders it unenforceable and, after consultation, Party A and Party B are unable to reach agreement on amending the employment Contract。 Party B is proved guilty of fraud, failing to reveal important information related to this Contract or Party B’s work. 抵達(dá)中國(guó)的時(shí)間太晚，以至于無(wú)法為其安排課程的。 Party B is sued for criminal liability in accordance with the law, gets administrative or judicial detention and receives pulsory detoxification treatment。 Party B mits serious dereliction of
