【正文】 e.　　　　第十七條　甲方交付的該房屋系驗(yàn)收合格的房屋。如該房屋的裝修、設(shè)備標(biāo)準(zhǔn)達(dá)不到本合同附件三約定的標(biāo)準(zhǔn)，乙方有權(quán)要求甲方按實(shí)際的裝修、設(shè)備與約定的裝修、設(shè)備差價(jià)__倍給予補(bǔ)償。如主體結(jié)構(gòu)不符合本合同附件三約定的標(biāo)準(zhǔn)，乙方有權(quán)單方面解除本合同。　　雙方商定對(duì)標(biāo)準(zhǔn)的認(rèn)定產(chǎn)生爭(zhēng)議時(shí)，委托本市有資質(zhì)的建設(shè)工程質(zhì)量檢測(cè)機(jī)構(gòu)檢測(cè)并以該機(jī)構(gòu)出具的書面鑒定意見(jiàn)為處理爭(zhēng)議的依據(jù)。This House delivered by Party shall be a house passes the check and acceptance. If the decoration, equipment of this House cannot reach the criteria described in Annex 3 of this Contract, Party B is entitled to ask Party A to reimburse 1 times of the price difference between the actual decoration, equipment and the agreed ones. If the main body structure is inconsistent with the criteria set forth in Annex 3 of this Contract, Party B is entitled to unilaterally rescind this Contract.Both parties agree, if there’s any dispute concerning the recognition of criteria, to entrust a qualified construction project quality inspection organ within Shanghai to make inspection and the settlement of dispute shall be subject to the written expert opinions issued by this organ.　　第十八條　該房屋交付后，乙方認(rèn)為主體結(jié)構(gòu)不合格的，可以委托本市有資質(zhì)的建筑工程質(zhì)量檢測(cè)機(jī)構(gòu)檢測(cè)。經(jīng)核驗(yàn)，確屬主體結(jié)構(gòu)質(zhì)量不合格的，乙方有權(quán)單方面解除本合同。After the delivery of this House, if Party B regards the main body structure as unqualified, he/she may entrust a qualified construction project quality inspection organ within Shanghai to make inspection. If, after inspection, the main body structure is found disqualified, Party B is entitled to unilaterally rescind this Contract.　　第十九條　乙方行使本合同條款中約定的單方面解除本合同權(quán)利時(shí)，應(yīng)書面通知甲方，甲方應(yīng)當(dāng)在收到乙方的書面通知起______天內(nèi)將乙方已支付的房?jī)r(jià)款（包括利息，利息按中國(guó)人民銀行公布的同期存款利率計(jì)算）全部退還乙方，并承擔(dān)賠償責(zé)任，賠償金額為總房?jī)r(jià)款的___%，在退還房?jī)r(jià)款時(shí)一并支付給乙方?！　∏翱罴氨竞贤渌麠l款所稱已支付的房?jī)r(jià)款是包括乙方直接支付的和通過(guò)貸款方式支付的房?jī)r(jià)款。Party B shall give a written notice to Party A if he/she executes the right to unilaterally rescind this Contract as agreed by the terms of this Contract. Party A shall, within 60 days upon receiving the written notice from Party B, return all the money paid by Party B(including interest, which will be calculated according to the deposit interest as then publicized by PBC) to Party B and bear the responsibility of indemnity, which amounts to% of the total price and shall be paid to Party B together with the refund of house price.The paid house price indicated hereinbefore and in other articles of this Contract shall include the money paid directly or by loan by Party B.　　第二十條　甲方交付該房屋有其他工程質(zhì)量問(wèn)題的，乙方在保修期內(nèi)有權(quán)要求甲方除免費(fèi)修復(fù)外，還須按照修復(fù)費(fèi)的___倍給予補(bǔ)償。　　雙方商定對(duì)該房屋其他工程質(zhì)量問(wèn)題有爭(zhēng)議的，委托本市有資質(zhì)的建設(shè)工程質(zhì)量檢測(cè)機(jī)構(gòu)檢測(cè)并以該機(jī)構(gòu)出具的書面鑒定意見(jiàn)為處理爭(zhēng)議的依據(jù)。If this House delivered by Party A is found with other quality problems, Party B, within the warranty period, is entitled to ask Party A, at Party A’s expense, to repair and get a pensation amounting to___times of the repair fees.Both parties agree ,if there’s any dispute concerning other quality problems of this House, to entrust a qualified construction project quality inspection organ within Shanghai to make inspection and the settlement of dispute shall be subject to the written expert opinions issued by this organ.　　第二十一條　自該房屋驗(yàn)收交接之日起，甲方對(duì)該房屋負(fù)責(zé)保修。保修范圍和保修期由甲乙雙方參照國(guó)務(wù)院分布的《建筑工程質(zhì)量管理?xiàng)l例》及《上海市房地產(chǎn)轉(zhuǎn)讓辦法》規(guī)定在本合同附件五中約定。From the day that this House is checked and handed over, Party A will be responsible for keeping it in good repair. The range and term of such guarantee will be negotiated in Annex 5 of this Contract by both parties with reference to Construction Project Quality Administration Regulation promulgated by the State Council and Shanghai Method for Real Estate Transfer.　　第二十二條　甲方已選聘________________________物業(yè)公司對(duì)該房屋進(jìn)行前期物業(yè)管理，并與其簽訂了《前期物業(yè)管理服務(wù)合同》（見(jiàn)附件五）。因該房屋規(guī)劃用途為_(kāi)________用房，甲乙雙方已簽訂了《_____________________使用公約》（見(jiàn)附件五）。Party A has engaged_________ to provide prophase realty management for this House and entered into with it a Prophase Realty Management Service Contract(see Annex 5).In consideration that the planned purpose of this House is for dwelling, Party A and Party B have signed a Use Pact of Residential Houses(see Annex 5).　　　第二十三條　乙方購(gòu)買的房屋及其相應(yīng)占有的土地使用權(quán)不可分離。自該房屋的房地產(chǎn)權(quán)利轉(zhuǎn)移之日起，甲方與_____________簽訂的土地使用權(quán)出讓/轉(zhuǎn)讓合同中約定的權(quán)利、義務(wù)和責(zé)任轉(zhuǎn)移給乙方。The House purchased by Party B and the proportioned land use right shall not be separated with each other. From the day that the real estate rights of this House are transferred, all the rights, obligations and responsibilities stipulated in the Land Use Right Assignment/Transfer Contract signed by Party A and(see supplementary clauses) shall be transferred to Party B.　　第二十四條　本合同項(xiàng)下乙方享有的權(quán)益（房屋期權(quán)），乙方可以依法轉(zhuǎn)讓、抵押。乙方依法行使上述權(quán)利時(shí)，甲方應(yīng)予協(xié)助。Party B may make legal transfer or mortgage of the rights and interests(options of the House) enjoyed by Party B according to this Contract. Party A shall assist when Party B executes the aforementioned right legally.　　第二十五條　本合同一方按照本合同約定向另一方送達(dá)的任何文件、回復(fù)及其他任何聯(lián)系，必須用書面形式，且采用掛號(hào)郵寄或直接送達(dá)的方式，送達(dá)本合同所列另一方的地址或另一方以本條所述方式通知更改后的地址。如以掛號(hào)郵寄的方式，在投郵后（以寄出的郵戳為準(zhǔn)）第_____日將被視為已送達(dá)另一方，如以直接送達(dá)的方式送達(dá)，則于另一方簽收時(shí)視為已送達(dá)。Any document, reply or other correspondence submitted as agreed in this Contract by one party to the other shall be in writing and delivered directly or in the form of registered post to the address of the other as stated in this Contract or to the changed address being notified by the other in a way described herein. In case of registered post, it shall be deemed to be received by the other party on the 5 days after it is mailed(subject to the postmark),in case of direct delivery, it shall be deemed to be received when signed and collected by the other party.　　第二十六條　該房屋買賣過(guò)程中所發(fā)生的稅費(fèi)按有關(guān)規(guī)定由甲、乙雙方各自承擔(dān)?！　axes occur during the trading of this House shall be borne respectively by both parties.　　第二十七條　本合同的補(bǔ)充條款、附件及補(bǔ)充協(xié)議均為本合同不可分割的部分。本合同補(bǔ)充條款、補(bǔ)充協(xié)議與正文條款不相一致的，以補(bǔ)充條款、補(bǔ)充協(xié)議為準(zhǔn)。　　本合同的未盡事宜及本合同在履行過(guò)程中需變更的事宜，雙方應(yīng)通過(guò)訂立變更協(xié)議進(jìn)行約定。Supplementary clauses, annexes and plementation agreement(s) of this Contract all constitute the integral part of this Contract. If there’s any discrepancy between the supplementary clauses, plementation agreement(s) of this Contract and the text, the former shall prevail.For any issue beyond this Contract and issue that needs change in execution of this Contract, both parties shall sign a modification agreement.　　第二十八條　甲、乙雙方在簽署本合同時(shí)，對(duì)各自的權(quán)利和義務(wù)清楚明白，并愿按本合同約定嚴(yán)格履行，如一方違反本合同，另一方有權(quán)按本合同約定要求索賠。Both parties are fully acquainted with their respective rights and obligations when signing
