________________年____月____日建設(shè)工程設(shè)計合同審查要點篇十二建設(shè)工程設(shè)計合同訂立合同雙方：建設(shè)單位：____，以下簡稱甲方。設(shè)計單位：____，以下簡稱乙方。為了明確責(zé)任，分工協(xié)作，共同完成國家建設(shè)項目的設(shè)計任務(wù)，根據(jù)《建設(shè)工程勘察設(shè)計合同條例》的規(guī)定和__批準(zhǔn)的計劃任務(wù)書，經(jīng)甲乙雙方充分協(xié)商，特簽訂本合同，以便共同遵守。第一條工程名稱、規(guī)模、投資額、建設(shè)地點甲主委托乙方承擔(dān)____工程的設(shè)計項目，建筑安裝面積為____平方米，批準(zhǔn)總投資為____萬元，建設(shè)地點在____。第二條甲方的義務(wù)，向乙方提交業(yè)經(jīng)上報批準(zhǔn)的設(shè)計任務(wù)書、工程選址報告，以及原料(或經(jīng)過批準(zhǔn)的資源報告)、燃料、水、電、運輸?shù)确矫娴膮f(xié)議文件和能滿足初步設(shè)計要求的勘察資料、需要經(jīng)過科研取得的技術(shù)資料。甲方在__年__月__日施工圖設(shè)計前，應(yīng)提供經(jīng)過批準(zhǔn)的初步設(shè)計文件和能滿足施工圖設(shè)計要求的勘察資料、施工的條件，以及有關(guān)設(shè)備的技術(shù)資料。甲方對上述資料必須保證質(zhì)量，不得隨意變更。，甲方應(yīng)組織有關(guān)施工單位，由乙方進(jìn)行設(shè)計技術(shù)交底。工程竣工后，甲方應(yīng)通知乙方參加竣工驗收。，甲方應(yīng)提供必要的工作條件，并在生活上予以方便，在設(shè)計和施工過程中因技術(shù)上的特殊需要進(jìn)行試驗，所需一切費用以及為配合甲方到外地的差旅費均由甲方負(fù)責(zé)。，不得擅自修改，未經(jīng)乙方同意，甲方不得復(fù)制、重復(fù)使用或擅自擴(kuò)大建設(shè)范圍。甲方有義務(wù)保護(hù)乙方的設(shè)計版權(quán)，不得轉(zhuǎn)讓給第三方重復(fù)使用。第三條乙方的義務(wù)，向甲方交付初步設(shè)計文件。在__年__月__日以前，向甲方交付技術(shù)設(shè)計文件。在__年__月__日以前，向甲方交付施工圖設(shè)計文件。其中，初步設(shè)計文件一式__份，技術(shù)設(shè)計文件一式__份，施工圖設(shè)計文件一式__份，甲方另需增添文件份數(shù)和需要模型費，另行收費。__年__月__日以前，乙方必須向甲方提交完畢所有設(shè)計文件(包括概預(yù)算文件、材料設(shè)備清單)。(大型建筑安裝工程，甲乙雙方可視具體情況分階段進(jìn)行設(shè)計，在具備設(shè)計條件時，雙方簽訂階段設(shè)計合同，具體規(guī)定甲方應(yīng)提交各階段設(shè)計資料的名稱和日期，乙方交付設(shè)計文件的日期，作為本合同的附件，詳見附件(2)。)，以及有關(guān)設(shè)計技術(shù)經(jīng)濟(jì)協(xié)議文件、設(shè)計標(biāo)準(zhǔn)、技術(shù)規(guī)范、規(guī)程、定額等提出勘察技術(shù)要求和進(jìn)行設(shè)計，提交符合質(zhì)量的設(shè)計文件。，在原定任務(wù)書范圍內(nèi)的必要修改，乙方應(yīng)負(fù)責(zé)承擔(dān)。，進(jìn)行施工前技術(shù)交底，解決施工中的有關(guān)設(shè)計問題，負(fù)責(zé)設(shè)計變更和修改預(yù)算，參加隱蔽工程驗收和工程竣工驗收。第四條設(shè)計的修改和停止，經(jīng)乙方同意后，除設(shè)計文件交付時間另定外，甲方應(yīng)按乙方實際返工修改工日，每工日按__元增付設(shè)計費，或按設(shè)計階段中返工的工作量百分比計算。，須具有設(shè)計審批機(jī)關(guān)或設(shè)計任務(wù)書批準(zhǔn)機(jī)關(guān)的意見書，經(jīng)雙方協(xié)商，另訂合同。已經(jīng)進(jìn)行了的設(shè)計費用的支付，按前條辦法計算。，應(yīng)及時用書面通知乙方，已付設(shè)計費不退，并按該階段的實際耗工時，增付和結(jié)清設(shè)計費，同時結(jié)束合同關(guān)系。第五條設(shè)計費的數(shù)量和交付辦法本設(shè)計合同生效后__天內(nèi)，甲方應(yīng)向乙方交付相當(dāng)于設(shè)計費的20%的定金，設(shè)計合同履行后，定金抵作設(shè)計費。乙方向甲方提交初步設(shè)計方案后__天內(nèi)，甲方應(yīng)向乙方支付__%的設(shè)計費。乙方向甲方提交施工圖文件后__天內(nèi)，甲方應(yīng)向乙方結(jié)清全部設(shè)計費(設(shè)計周期較長的大型工程項目，施工圖階段的設(shè)計費，可按單項工程設(shè)計完成后分別撥付)。第六條獎勵與違約責(zé)任，由于乙方采用先進(jìn)技術(shù)或合理建議而節(jié)省了工程投資，可以從節(jié)約投資額中提取__%獎勵乙方。、準(zhǔn)確提供有關(guān)設(shè)計資料，致使乙方無法進(jìn)行設(shè)計或造成設(shè)計返工，乙方除可將設(shè)計文件交付日期順延外，還應(yīng)由甲方按乙方實際損失工日，以每日__元計算增付設(shè)計費。，應(yīng)根據(jù)銀行關(guān)于延期付款的規(guī)定，向乙方償付違約金。，延誤設(shè)計文件的交付時間，每延誤__天，乙方應(yīng)向甲方償付相當(dāng)于設(shè)計費的__%的違約金(甲方可在設(shè)計費中扣除)。，應(yīng)由乙方繼續(xù)完善設(shè)計任務(wù)，并視造成的損失浪費大小減收或免收設(shè)計費。對于因乙方設(shè)計錯誤造成工程重大質(zhì)量事故者，乙方除免收受損失部分的設(shè)計費外，還應(yīng)付與直接受損失部分設(shè)計費相等的賠償金。第七條其它_________________________________。本合同自__年__月__日雙方簽字后生效，全部設(shè)計任務(wù)完成后失效。本合同如有未盡事宜，需經(jīng)雙方共同協(xié)商，作出補(bǔ)充規(guī)定。補(bǔ)充協(xié)定與本合同具有同等效力，但不得與本合同內(nèi)容抵觸。在合同執(zhí)行中如發(fā)生糾紛，雙方應(yīng)及時協(xié)商解決。協(xié)商不成時，雙方屬于同一部門的，由上級主管部門調(diào)解。調(diào)解不成，或不屬于同一部門的，可向國家規(guī)定的合同管理機(jī)關(guān)申請仲裁，也可以直接向人民法院起訴。本合同正本一式二份，甲乙雙方各執(zhí)一份。合同副本一式__份，送計委、建委、建行……等單位各留存一份。建設(shè)單位(甲方)：設(shè)計單位(乙方)：代表人：____代表人：____聯(lián)系人：____聯(lián)系人：____通訊處：____通訊處：____電話或電報：____電話或電報：____開戶銀行：____開戶銀行：____帳號：____帳號：______年__月__日訂建設(shè)工程設(shè)計合同審查要點篇十三建設(shè)工程設(shè)計合同construction
