【文章內(nèi)容簡介】 Party A requires to terminate or cancel the Contract before the Party B starts the design work, the Party B will not return the down payment already deposit paid by the Party B。 if the Party B has started the design work, the Party A shall pay for the actual workload already done by the Party B. When the actual workload of the design is less than half of the work at the stage, the Party A shall pay half of design charges at the stage. When the actual workload of the design is more than half of the work at the stage, the Party A shall pay all the charges for design work at the stage.9．1．4甲方應(yīng)按本合同規(guī)定的金額和日期向乙方支付設(shè)計(jì)費(fèi)，逾期支付的，每天承擔(dān)應(yīng)支付金額百分之一的違約金，且乙方提交設(shè)計(jì)文件的時(shí)間順延。逾期超過30天以上時(shí)，乙方有權(quán)暫停履行下階段工作，并書面通知甲方。甲方或其他審批單位對設(shè)計(jì)文件不審批或本合同項(xiàng)目暫停緩建，甲方均應(yīng)支付應(yīng)付的設(shè)計(jì)費(fèi)。 The Party A should pay the design charges to the Party B based on the amount and date provided in this Contract. For overdue payment, the Party A should pay 1% of overdue payment as penalty, and the time for delivery by the Party B shall be will be extended accordingly. If the delay of the payment exceeds more than 30 days, the Party B shall have the right to suspend the performance of the work at the next stage and give the written notice to the Party A. In case the Party A or other approval units would not approve the design documents or the construction of this Contract is suspended, the Party A should also pay the payable design charges.9．1．5甲方要求乙方在合同規(guī)定時(shí)間提前交付設(shè)計(jì)文件時(shí)，須征得乙方同意，不得嚴(yán)重背離合理設(shè)計(jì)周期，且甲方應(yīng)給予補(bǔ)償。If the Party A requires the Party B to delivery the design documents in advance within specified time, it should get the prior consent of the Party B without serious deviation from the reasonable design circle, and the Party A shall pay the pensation.9．1．6甲方應(yīng)為乙方派駐現(xiàn)場的工作人員提供工作、生活及交通等方面的便利條件及必要的勞動保護(hù)裝備。The Party A should provide convenient conditions including working, living and traffic and so forth as well as necessary labor protection equipments for the workers whom the Party B appoints to the jobsite.9．2乙方責(zé)任Responsibilities of the Party B9．2．1乙方應(yīng)按國家規(guī)定和合同約定的技術(shù)規(guī)范標(biāo)準(zhǔn)進(jìn)行設(shè)計(jì)，按本合同第六條規(guī)定的內(nèi)容、時(shí)間及份數(shù)向甲方交付設(shè)計(jì)文件（出現(xiàn)9．1．9．1．9．1．9．1．5規(guī)定有關(guān)交付設(shè)計(jì)文件順延的情況除外）。并對提交的設(shè)計(jì)文件的質(zhì)量負(fù)責(zé)。The Party B should carry out design work in accordance with technical standards provided in national regulations and the Contract, and submit design documents to the Party A according to the contents、time、and copies specified in Article Six of this Contract(except for the circumstances provided in Article 9．1．9．1．9．1．9．1．5 under which the delivery of design documents may be extended ), and shall be responsible for the quality of the design documents.9．2．2設(shè)計(jì)合理使用年限為25年（膠、五金配件等附件為10年）。The reasonable design life is 25 years (10 years for sealant, hardware fittings and so forth).9．2．3負(fù)責(zé)對外的設(shè)計(jì)資料進(jìn)行審查，負(fù)責(zé)該合同項(xiàng)目的設(shè)計(jì)聯(lián)絡(luò)工作。T
