B.□將款項(xiàng)定性為房款的法律責(zé)任:甲乙雙方中若有任何一方未按照本協(xié)議中的約定及時(shí)全面履行自己的義務(wù),則每逾期一日,違約方應(yīng)按本協(xié)議約定總房款的萬(wàn)分之三向守約方支付違約金,直至違約方實(shí)際履行之日止;逾期超過(guò)15日的,守約方有權(quán)選擇單方面解除本協(xié)議,若守約方選擇單方面解除本協(xié)議,則違約方應(yīng)按本協(xié)議約定的總房款的20%向守約方支付違約金。倘若甲、乙雙方基于本協(xié)議正式簽署《上海市房地產(chǎn)買賣合同》并依約履行;丙方將無(wú)償協(xié)助提供過(guò)戶、交房等后續(xù)服務(wù),直至本交易完結(jié)。二甲、乙雙方協(xié)商該房屋交驗(yàn)前所發(fā)生的水費(fèi)、電費(fèi),暖氣費(fèi),物業(yè)等相關(guān)費(fèi)用有甲方承擔(dān),驗(yàn)后發(fā)生的各種費(fèi)用及風(fēng)險(xiǎn)由乙方承擔(dān)。但甲方應(yīng)退還乙方已支付的定金及房款。居間傭金費(fèi)元;信息咨詢費(fèi)元;產(chǎn)權(quán)代辦費(fèi)元;貸款代辦費(fèi)元;落戶代辦費(fèi)元,由方承擔(dān);土地證代辦費(fèi)元,由方承擔(dān);贖證、注銷抵押代辦費(fèi)元,由方承擔(dān);其他代辦費(fèi)元,由方承擔(dān)。保證贈(zèng)送物品沒(méi)有缺失,如有毀損或缺失,應(yīng)由甲方承擔(dān)相應(yīng)賠付責(zé)任。七、費(fèi)用責(zé)任本次交易是否辦理委托公證由雙方協(xié)商,如需公證,費(fèi)用由辦理交易需交納稅費(fèi)以實(shí)際發(fā)生額為準(zhǔn)。第三條付款方式與時(shí)間簽訂本合同時(shí),乙方須向甲方支付購(gòu)房定金¥:萬(wàn)仟約定付款方式采用下述第①銀行按揭貸款付款:a)受理后按銀行要求將首期款(為總房款減去銀行按揭款,銀行按揭款及貸款年限、利率等以銀行批準(zhǔn)為準(zhǔn))存入銀行指定帳戶,剩余房款將通過(guò)銀行按揭貸款手續(xù)支付,放款時(shí)間以銀行為準(zhǔn)。甲方在收取購(gòu)房首期款時(shí)須支付¥:仟佰為水、電、氣、閉過(guò)戶及交房押金,此款由方保管,辦理完相關(guān)手續(xù)及后由方支付給甲方。若因甲方原購(gòu)房時(shí)未繳納相關(guān)稅金和費(fèi)用,需補(bǔ)繳有關(guān)的稅金和費(fèi)用,則由方負(fù)責(zé)補(bǔ)繳。房屋所有權(quán)人,房屋所有權(quán)證號(hào)。六、丙方權(quán)利義務(wù)在公平、公正、公開的原則下,為甲、乙雙方提供房地產(chǎn)居間服務(wù)。并賠償由此給乙方和丙方造成的損失。二、居間擔(dān)保服務(wù)現(xiàn)金付款乙方在年月日內(nèi)將房款(扣除定金)一次性付給丙方(丙方代甲方收?。?,并同時(shí)付丙方傭金。[第九條]
