【正文】 The licenseissuing bodies at the provincial level and those at the city level shall be responsible for the supervision and administration of the operating licenses within their respective administrative areas. Chapter II Application and Examination amp。s Republic of China shall be governed by the present Measures. The present Measures shall not apply to the operation of explosives， radioactive materials， nuclear energy materials to be used for civil purpose and urban gas. Article 3 The state shall apply a license system for the operation and marketing of hazardous chemicals. An entity operating and marketing hazardous chemicals shall obtain the operating license for hazardous chemicals （ hereinafter referred to as the operating license） pursuant to the present Measures， and shall apply for registration with the department of industry and merce administration on the basis of the operating license pursuant to law. Without the operating license or industry and merce registration， no entity or individual may operate or market hazardous chemicals. Article 4 Operating licenses are divided into type A and type B. An entity with the operating license of type A may operate and market highly toxic chemicals and other hazardous chemicals； an entity with operating license of type B may only operate and market the hazardous chemicals other than highly toxic chemicals. Operating licenses of type A shall be subject to examination and approval， and issued by the departments in charge of economy and trade of the people39。 國家經(jīng)濟(jì)貿(mào)易委員會(huì)主任 李榮融 二 ○○二年十月八日 Measures for The Administration of Operating Licenses for Hazardous Chemicals Order of the State Economic and Trade Commission of the People39。 第二十二條 發(fā)證機(jī)關(guān)的工作人員徇私舞弊、濫用職權(quán)、弄虛作假、玩忽職守的，依據(jù)《危險(xiǎn)化學(xué)品安全管理?xiàng)l例》第五十五條的規(guī)定給予降級(jí)或者撤職的行政處分；構(gòu)成犯罪的，依法追究刑事責(zé)任。 第三章 經(jīng)營許可證的監(jiān)督管理 第十六條 發(fā)證機(jī)關(guān)應(yīng)當(dāng)堅(jiān)持公開、公平、公正的原則，嚴(yán)格依照法律、法規(guī)、規(guī)章和標(biāo)準(zhǔn)規(guī)定的條件及程序，審批、發(fā)放經(jīng)營許可證。 第十條 發(fā)證機(jī)關(guān)應(yīng)當(dāng)在接到申請之日起 30 個(gè)工作日內(nèi)，對(duì)申請人提交的材料進(jìn)行審查和現(xiàn)場核查，對(duì)符合條件的，頒發(fā)經(jīng)營許可證；對(duì)不符合條件的，應(yīng)當(dāng)書面通知申請人并說明理由。 甲種經(jīng)營許可證由省、自治區(qū)、直轄市人民政府經(jīng)濟(jì)貿(mào)易主管部門或其委托的安全生產(chǎn)監(jiān)督管理部門（以下簡稱省級(jí)發(fā)證機(jī)關(guān)）審批、頒發(fā)；乙種經(jīng)營許可證由設(shè)區(qū)的市級(jí)人民政府負(fù)責(zé)危險(xiǎn)化學(xué)品安全監(jiān)督管理綜合工作的部門（以下簡稱市級(jí)發(fā)證機(jī)關(guān)）審批、頒發(fā)。 第一章 總 則 第一條 為加強(qiáng)危險(xiǎn)化學(xué)品安全管理，規(guī)范危險(xiǎn)化學(xué)品經(jīng)營銷售活動(dòng)，保障人民群眾生命、財(cái)產(chǎn)安全，根據(jù)《中華人民共和國安全生產(chǎn)法》和《危險(xiǎn)化學(xué)品安全管理?xiàng)l例》，制定本辦法。未取得經(jīng)營許可證和未經(jīng)工商登記注冊，任何單位和個(gè)人不得經(jīng)營銷售危險(xiǎn)化學(xué)品。 第七條 申請經(jīng)營許可證的單位自主選擇具有資質(zhì)的安全評(píng)價(jià)機(jī)構(gòu)，對(duì)本單位的經(jīng)營條件進(jìn)行安全評(píng)價(jià)。有效期滿后，經(jīng)營單位繼續(xù)從事危險(xiǎn)化 學(xué)品經(jīng)營活動(dòng)的，應(yīng)當(dāng)在經(jīng)營許可證有效期滿前 3 個(gè)月內(nèi)向原發(fā)證機(jī)關(guān)提出換證申請，經(jīng)審查合格后換領(lǐng)新證。經(jīng)營單位應(yīng)當(dāng)接受發(fā)證機(jī)關(guān)依法實(shí)施的監(jiān)督檢查，無正當(dāng)理由不得拒絕、阻撓。 第二十六條 經(jīng)營許可證由國家安全生產(chǎn)監(jiān)督管理局統(tǒng)一 印制。39。 Approval of Operating License Article 6 An entity operating and marketing hazardous chemicals （ hereinafter referred to as operating entity） shall meet the following conditions： 1） The places， facilities and constructions for operation and storage shall meet the Criteria for Fire Control in Construction Design （ GBJ16）， the Provisions on the Safety of Explosion Hazardous Places and the Rules on Fire Control of Warehouses etc， and the constructions shall pass the examination conducted by the bodies of public security and fire control before being accepted； 2） The conditions for operation and storage shall meet the Practice Conditions and Techni
