Article 2 Those engaging in the operation and marketing of hazardous chemicals within the People39。 第四章 罰則 第二十條 未取得經(jīng)營許可證,擅自從事危險化學(xué)品經(jīng)營的,由省級發(fā)證機(jī)關(guān)或市級發(fā)證機(jī)關(guān)依照《危險化學(xué)品安全管理條例》第五十七條的規(guī)定予以處罰。 第八條 安全評價機(jī)構(gòu)應(yīng)當(dāng)對申請經(jīng)營許可證的單位是否符合本辦法第六條規(guī)定的條件逐項進(jìn)行評價,并出具安全評價報告。危險化學(xué)品經(jīng)營許可證管理辦法 Measures for The Administration 國家經(jīng)濟(jì)貿(mào)易委員會令第 36 號 《危險化學(xué)品經(jīng)營許可證管理辦法》已經(jīng)國家經(jīng)濟(jì)貿(mào)易委員會主任辦公會議審議通過,現(xiàn)予公布,自2020 年 11 月 15 日起施行。 第九條 申請甲種和乙種經(jīng)營許可證的單位,應(yīng)當(dāng)分別向省級發(fā)證機(jī)關(guān)和市級發(fā)證機(jī)關(guān)提出申請,提交下列材料: (一)《危險化學(xué)品經(jīng)營許可證申請表》; (二)安全評價報告; (三)經(jīng)營和儲存場所建筑物消防安全驗收文件的復(fù)印件; (四)經(jīng) 營和儲存場所、設(shè)施產(chǎn)權(quán)或租賃證明文件復(fù)印件; (五)單位主要負(fù)責(zé)人和主管人員、安全生產(chǎn)管理人員和業(yè)務(wù)人員專業(yè)培訓(xùn)合格證書的復(fù)印件; (六)安全管理制度和崗位安全操作規(guī)程。 第二十一條 經(jīng)營單 位違反本辦法規(guī)定,有下列行為之一的,由發(fā)證機(jī)關(guān)吊銷經(jīng)營許可證: (一)提供虛假證明文件或采取其他欺騙手段,取得經(jīng)營許可證的; (二)不再具備經(jīng)營銷售危險化學(xué)品基本條件的; (三)轉(zhuǎn)讓、買賣、出租、出借、偽造或者變造經(jīng)營許可證的。39。39。經(jīng)營單位應(yīng)當(dāng)接受發(fā)證機(jī)關(guān)依法實施的監(jiān)督檢查,無正當(dāng)理由不得拒絕、阻撓。 第七條 申請經(jīng)營許可證的單位自主選擇具有資質(zhì)的安全評價機(jī)構(gòu),對本單位的經(jīng)營條件進(jìn)行安全評價。 第一章 總 則 第一條 為加強(qiáng)危險化學(xué)品安全管理,規(guī)范危險化學(xué)品經(jīng)營銷售活動,保障人民群眾生命、財產(chǎn)安全,根據(jù)《中華人民共和國安全生產(chǎn)法》和《危險化學(xué)品安全管理條例》,制定本辦法。 第十條 發(fā)證機(jī)關(guān)應(yīng)當(dāng)在接到申請之日起 30 個工作日內(nèi),對申請人提交的材料進(jìn)行審查和現(xiàn)場核查,對符合條件的,頒發(fā)經(jīng)營許可證;對不符合條件的,應(yīng)當(dāng)書面通知申請人并說明理由。 第二十二條 發(fā)證機(jī)關(guān)的工作人員徇私舞弊、濫用職權(quán)、弄虛作假、玩忽職守的,依據(jù)《危險化學(xué)品安全管理條例》第五十五條的規(guī)定給予降級或者撤職的行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。s Republic of China shall be governed by the present Measures. The present Measures shall not apply to the operation of explosives, radioactive materials, nuclear energy materials to be used for civil purpose and urban gas. Article 3 The state shall apply a license system for the operation and marketing of hazardous chemicals. An entity operating and marketing hazardous chemicals shall obtain the operating license for hazardous chemicals ( hereinafter referred to as the operating license) pursuant to the present Measures, and shall apply for registration with the department of industry and merce administration on the basis of the operating license pursuant to law. Without the operating license or industry and merce registration, no entity or individual may operate or market hazardous chemicals. Article 4 Operating licenses are divided into type A and type B. An entity with the operating license of type A may operate and market highly toxic chemicals and other hazardous chemicals; an entity with operating license of type B may only operate and market the hazardous chemicals other than highly toxic chemicals. Operating licenses of type A shall be subject to examination and approval, and issued by the departments in charge of economy and trade of the people39。 executive meeting of the State Economic and Trade Commission, and are hereby promulgated for implementation on November 15, 2020.
