【正文】 所提出的索賠要求。雙方當(dāng)事人如果沒(méi)有約定，“訂金”的性質(zhì)主要是預(yù)付款，賣方違約時(shí)，應(yīng)無(wú)條件退款；買方違約時(shí)，可以與賣方協(xié)商解決并要求對(duì)方退款。合同上是 “ 定金 ” 的，依據(jù) 《 合同法 》 相關(guān)規(guī)定，一方違約時(shí)，雙方有約定的按照約定執(zhí)行；如果無(wú)約定，賣方違約時(shí)，“定金”雙倍返還；買方違約時(shí)，“定金”不返還。 與貿(mào)易有關(guān)國(guó)家所制定的強(qiáng)制性執(zhí)行的法規(guī)標(biāo)準(zhǔn) 國(guó)際權(quán)威性標(biāo)準(zhǔn) 買賣合同中的檢驗(yàn)條款 It is mutually agreed that the Inspection Certificate of quality and quantity (weight) issued by ╳at the port of shipment shall be part of the documents to be presented for negotiation under the relevant L/C.
