【正文】 b. On the basis of the physician’s diagnosis, Party B fails to resume normal work after a sick leave for a period of successive 30 days. (2) Party B has the right to inform Party A in writing of Cancellation of this contract under the following conditions: a. Party A fails to provide Party B with necessary working and living conditions as stipulated in this contract。 當事人一方要求簽訂新合同，應(yīng)當在 本 合同期滿 30 天前向另一 方提出，經(jīng)雙方協(xié)商一致同意后簽訂新的合同。如雙方認為有必要約定確切數(shù)額或更高或更低的違約金，應(yīng)當在合同附件中寫明。 (2)聘方未按時支付受聘方報酬。經(jīng)當事人雙方協(xié)商同意后， 可以變更。 (二 )遵守聘方的工作制度和有關(guān)外國 專家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導、檢查和評估。 四、受聘方 的稅前月薪為人民幣 元，其中 %可按月兌換外匯。其他有關(guān)待遇見附件。未經(jīng)聘方同意，不得兼職。在未達成一致意見前，仍應(yīng)當嚴格履行合同。 當事人一方要求解除合同，應(yīng)提前 30 天以書面形式向另一方提出， 30 天以后方可解除合 同。 受聘方因不可抗力事件要求解除合同，需 出具有關(guān)機構(gòu)證明。 受聘方合同期滿后，在華逗留期間的一切費用自理。 b. Party A fails to pay Party B as scheduled. (3) In Case either party asks to terminate this contract, it shall give a 30 day notice to the other party in writing, and the contract shall only be terminated after 30 days. (4) This contract can be terminated upon mutual agreement by both parties. 3. Termination of the contract (1) This contract shall be terminated once it expires. (2) This contract may be terminated with mutual consent of both parties, and it shall be strictly observed until both parties reach an agreement otherwise. VIII. Breach Penalty When either party fails to fulfill any part or all of the obligations as stipulated in this contract, that is, in the event of breach of the contract, the said party shall pay a breach penalty of US$800 to 3000 or equivalent to 3 to 10 times Party B’s monthly salary in RMB.
