【正文】 s Armed Police Force shall be formulated jointly by the Ministry of Public Health, the General Logistics Department of the Chinese People39。 (3) those who supply or oversupply narcotics to any unit or person that has not been granted the permission to use the stuff。 第三十八條 本辦法自發(fā)布之日起施行。 第三十二條 違反本辦法規(guī)定，擅自種植罌粟的，或者非法吸食麻醉藥品的，由公安機(jī)關(guān)依照 治安管理處罰條例或有關(guān)的規(guī)定給予處罰。 第二十八條 醫(yī)療單位應(yīng)加強(qiáng)對(duì)麻醉藥品的管理。管理范圍內(nèi)沒有的制劑或因醫(yī)療單位特殊需要的制劑，有麻醉藥品使用權(quán)的醫(yī)療單位經(jīng)縣以上衛(wèi)生行政部門批準(zhǔn)，可以自行配制，其他任何單位不得自行配制。 第二十二條 麻醉藥品使用單位在采購麻醉藥品時(shí)，須向麻醉藥品經(jīng)營單位填送 麻醉藥品申購單 。麻醉藥品進(jìn)出口的年度計(jì)劃應(yīng)當(dāng)報(bào)衛(wèi)生部審批。 第四章 麻醉藥品的運(yùn)輸 第十三條 運(yùn)輸藥用阿片時(shí)，必須憑衛(wèi)生部簽發(fā)的國內(nèi)運(yùn)輸憑照辦理運(yùn)輸手續(xù)，原植物的種植單位調(diào)給國家醫(yī)藥管理局倉庫的藥用阿片由發(fā)貨單位派人押運(yùn)，由倉庫調(diào)往藥品生產(chǎn)企業(yè)的由收貨單位派人押運(yùn)。全國麻醉藥品的供應(yīng)計(jì)劃由國家醫(yī)藥管理局挃定的部門提出，報(bào)衛(wèi)生部、國家醫(yī)藥管理局審查批準(zhǔn)后下達(dá)執(zhí)行。 麻醉藥品的生產(chǎn)單位，必須經(jīng)衛(wèi)生部會(huì)同國家醫(yī)藥管理局審查批準(zhǔn)。 第三條 麻醉藥品包括：阿片類、可卡因類、大麻類、合成麻醉藥類及衛(wèi)生部挃定的其他易成癮癖的藥 品、藥用原植物及其制劑。 第八條 麻醉藥品新品種的研究試制，必須由研制單位編制計(jì)劃，報(bào)經(jīng)衛(wèi)生部審定批準(zhǔn)后，方可進(jìn)行。罌粟殼可供醫(yī)療單位配方使用和由縣以上衛(wèi)生行政部門挃定的經(jīng)營單 位憑蓋有醫(yī)療單位公章的醫(yī)生處方配方使用，不準(zhǔn)零售。鐵路運(yùn)輸不得使用敞車，水路運(yùn)輸不得配裝倉面，公路運(yùn)輸應(yīng)當(dāng)苫蓋嚴(yán)密，捆扎牢固。設(shè)有病床具備進(jìn)行手術(shù)或一定醫(yī)療技術(shù)條件的醫(yī)療單位，可向當(dāng)?shù)匦l(wèi)生行政部門辦理申請(qǐng)手續(xù)，經(jīng)上一級(jí)衛(wèi)生行政部門批準(zhǔn)，核定供 應(yīng)級(jí)別后，發(fā)給 麻醉藥品購用印鑒卡 ，該單位應(yīng)按照麻醉藥品購用限量的規(guī)定，向挃定的麻 醉藥品經(jīng)營單位購用。郵寄麻醉藥品時(shí)，麻醉藥品經(jīng)營單位應(yīng)在包裹詳情單上加蓋 麻醉藥品專用章 。醫(yī)務(wù)人員不得為自 己開處方使用麻醉藥品。 第二十九條 因搶救病人急需麻醉藥品的，有關(guān)醫(yī)療單位和麻醉藥品經(jīng)營單位應(yīng)立即迅速辦理，但只限于該病例一次性使用劑量，手續(xù)不完備的，可事后補(bǔ)辦。對(duì)處罰決定不服而逾期又不起訴的，原處理機(jī)關(guān) 可向人民法院申請(qǐng)強(qiáng)制執(zhí)行。s Republic of China on November 28, 1987) Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Medicine Administration Law of the People39。s court, the authorities that impose the sanction shall apply to the people39。s Republic of China on September 13, 1978, shall bee null and void on the same day. 。 (6) those who apply any new kind of narcotic drugs to patients clinically or have produced any new kind of narcotic drugs without authorization.
