Contract Price 合同價(jià)格 In consideration of Contractor undertaking the Contract and pleting the Contract Works as set out in Clause 4, the Owner hereby agrees to pay Contractor a Contract Price of RMB . The Contract Price shall be payable in the manner as specified in Annex 3.合同價(jià)格為人民幣： 元整（人民幣 元整）。付款日期之后或付款期到期后仍未支付承包商的款項(xiàng)將計(jì)收利息。如業(yè)主資金狀況確需高于此比例支付承兌匯票，根據(jù)雙方協(xié)商確定，承兌匯票比例可以提高。因業(yè)主原因?qū)е碌捻?xiàng)目延期，見(jiàn)本合同第18條第3款；(d) Changes proposed by Contractor, SubContractor, Consultant, and/or Supplier which have been agreed in writing by both the Owner and Contractor經(jīng)業(yè)主、承包商書(shū)面同意的由承包商、分包商、咨詢顧問(wèn)和/或供應(yīng)商提出的變更；(e) Changes due to governmental and other regulatory requirements。 合同工作將按照合同規(guī)定的方式開(kāi)展；b) that Contractor including the SubContractors and Suppliers shall ply with the specifications and drawings。8. Warranty Period 質(zhì)保期 The warranty period for the Contract Works (“Warranty Period”) shall be twelve (12) calendar months mencing from the Date of Acceptance, which shall not be later than sixty (60) calendar days after substantial pletion. The Owner shall notify Contractor in writing immediately of any defects that appear during the Warranty Period. The Warranty Period shall follow the related requirement of the Chinese laws and regulations. The warranty period for each single equipment shall be the warranty period mitted by the Supplier. Repair work for the facility system shall be responsible by the Owner after the Warranty Period. However, if the Owner requires Contractor to do the repair work, Contractor shall provide the repair work service with service fee and material charges to the Owner.合同工作的質(zhì)保期為12個(gè)日歷月，自驗(yàn)收之日起算，驗(yàn)收日不得遲于實(shí)際完工（包括質(zhì)量整改）后60日歷日。 When any defects which may have been required to be rectified has been rectified, The Owner shall issue a Certificate of Completion of Making Good Defects. 如業(yè)主認(rèn)為缺陷已按要求修補(bǔ)，可頒發(fā)缺陷修補(bǔ)完工證書(shū)。 Contractor will appoint a site warranty inspection team for fast response during the Warranty Period, with the related personnel’s’ contact information to be posted clearly on the site office.承包商將在現(xiàn)場(chǎng)設(shè)立質(zhì)量保證組，確保質(zhì)保期內(nèi)的快速反應(yīng)能力。10. Limit of Liability責(zé)任限額 The maximum aggregate liability of Contractor arising our of or relating to any manner to the performance or nonperformance of obligations in connection with this Contract, whether based on contract, warranty, guaranty, indemnity, tort, or otherwise, shall in no way exceed 30% of the Contract Price.由于承包商對(duì)合同義務(wù)的執(zhí)行的行為或者不作為導(dǎo)致的，無(wú)論依據(jù)合同，質(zhì)保，保證，賠償，侵權(quán)或者其他，承擔(dān)不超過(guò)30%合同總額的責(zé)任。有特別約定除外。 Contractor may store the Facility Systems, equipment or parts thereof with the Owner’s approval on the site at its own risk. If, in the opinion of the Project Manager, the storage of the Facility Systems, equipment or parts thereof causes obstruction to any other constructional activities undertaken by Contractors engaged directly by the Owner either on the Site or at other part of the Owner’s land, the Project Manager shall be empowered to give Contractor instructions to such other Contractors to remove the cause of such obstruction. Instructions, Directions and Progress Reports 指示、指令及進(jìn)度報(bào)告 The Owner shall furnish without charge and within five (5) working days all pertinent data and information available to Contractor and shall give such assistance as shall reasonably be required by Contractor for carrying out of its duties under this Contract. The Owner shall give its decision on all sketches, drawings, reports, remendations and other matters properly referred to for decision by Contractor in such reasonable time as not to delay or disrupt the performance by Contractor of its services under this Contract.業(yè)主應(yīng)在5個(gè)工作日內(nèi)無(wú)償向承包商提供所有相關(guān)的資料和信息，并應(yīng)根據(jù)承包商的合理要求協(xié)助其完成本合同項(xiàng)下的責(zé)任。13.
