In short, as the sustainable development of China39。而目前知識產(chǎn)權發(fā)展變化的推動力量來自發(fā)達國家,他們意圖通過實施知識產(chǎn)權策略把自己的科技優(yōu)勢上升為知識產(chǎn)權優(yōu)勢,進一步提高競爭力。因此,促進對外貿(mào)易健康發(fā)展,中國要完善知識產(chǎn)權保護體系,實施知識產(chǎn)權戰(zhàn)略。專利轉讓,專利和商標的許可使用權、版權的許可等,已在各國之間的貿(mào)易中占有一定的比例;含有知識產(chǎn)權的產(chǎn)品在國際貿(mào)易中所占的比重越來越大,例如新的藥品和其他高科技產(chǎn)品,電影、音樂、書籍、計算機軟件,知名品牌商品,植物新品種等等。各國都利用知識產(chǎn)權制度,保護自己的技術優(yōu)勢、品牌優(yōu)勢并力圖阻正外來更強大的技術優(yōu)勢的沖擊。就我國而言,隨著高新技術產(chǎn)品進出日的不斷增加,知識產(chǎn)權在我國對外貿(mào)易中的地位日益突出。從長遠發(fā)展趨勢看,這種態(tài)勢只會強化不會削弱。我國對外貿(mào)易也已經(jīng)發(fā)展到尊重并保護知識產(chǎn)權階段,應該實施國家知識產(chǎn)權戰(zhàn)略。在這一點上,商標權人與專利權人、版權人希望通過技術壟斷、版權獨占來獲取更多的利益是不同的。商標僅僅是生產(chǎn)經(jīng)營者為了使自己生產(chǎn)經(jīng)營的商品或提供的服務 便于消費者識別所采用的一種標記,其主要功能在于商品流通過程中區(qū)別商品、服務的提供者,促進消費者信息。
