不正當(dāng)競爭案件,營造公平競爭的市場環(huán)境。進一步完善外商投資企業(yè)年檢匯總報告制度,強化對年檢信息的整理分析,準(zhǔn)確掌握外商投資企業(yè)的動態(tài)情況。(十五)切實提高外商投資企業(yè)出資到位率。努力提高外資登記管理數(shù)據(jù)質(zhì)量,建立外資登記管理數(shù)據(jù)綜合利用和發(fā)布機制,及時匯總外資市場主體登記管理信息,加強對外資市場主體登記信息和外商投資企業(yè)發(fā)展情況的分析,充分發(fā)揮外資市場主體登記管理的公共服務(wù)職能作用,為外商投資企業(yè)發(fā)展服務(wù)。不斷完善網(wǎng)上服務(wù)功能,建立健全“授權(quán)登記+遠(yuǎn)程核準(zhǔn)+網(wǎng)上申請”的登記模式,推進外資登記注冊窗口前移。三、著力提高服務(wù)外商投資企業(yè)發(fā)展的能力(十一)進一步提高外商投資企業(yè)登記服務(wù)質(zhì)量。(九)積極服務(wù)利用外資方式多樣化。加大服務(wù)支持力度,完善登記服務(wù)體制,加強外資登記工作銜接,對東部地區(qū)外商投資企業(yè)向中西部地區(qū)轉(zhuǎn)移的,落實首辦責(zé)任制,全程跟蹤,積極提供高效率的遷出、遷入登記注冊服務(wù)。除有特別規(guī)定外,外商投資服務(wù)業(yè)企業(yè)及其授權(quán)的分公司可以直接向所在地登記機關(guān)申請辦理其他經(jīng)營性分支機構(gòu)的登記手續(xù)。(四)積極幫扶外商投資企業(yè)緩解出資困難。積極研究債權(quán)出資管理辦法,規(guī)范出資行為。鼓勵外商投資舉辦的投資性公司申請組建企業(yè)集團。企業(yè)集團的名稱可以有簡稱。認(rèn)真做好外商投資企業(yè)出資方式變更登記,經(jīng)外匯管理部門登記和審批部門批準(zhǔn),積極支持外商投資企業(yè)的投資者以其對該企業(yè)的債權(quán)轉(zhuǎn)增為注冊資本。對已繳付首期注冊資本,無違法記錄,因資金暫時緊張無法按時出資的外商投資企業(yè)申請延長出資期限的,經(jīng)審批部門批準(zhǔn),及時為其辦理出資期限變更登記。(六)大力支持跨國公司設(shè)立功能性機構(gòu)和外商投資服務(wù)外包產(chǎn)業(yè)。(八)積極服務(wù)邊境經(jīng)濟合作區(qū)建設(shè)。積極參與外資并購聯(lián)合審查,依法規(guī)范外資并購過程中的公司登記事項,在登記注冊環(huán)節(jié)提供優(yōu)質(zhì)服務(wù),積極支持外資以參股、并購等方式參與國內(nèi)企業(yè)改組改造和兼并重組。全面落實“一審一核”制度,減少審核環(huán)節(jié),明確審查、核準(zhǔn)人員的職權(quán)和責(zé)任,進一步規(guī)范登記行為。逐步實現(xiàn)登記材料網(wǎng)上申報、網(wǎng)上預(yù)審、窗口一次性辦結(jié),切實提高外資登記注冊效率。(十四)認(rèn)真執(zhí)行國家利用外資產(chǎn)業(yè)政策。加強對外商投資企業(yè)股東出資行為的規(guī)范管理,以首期出資為重點,規(guī)范出資行為,建立出資提示、出資催繳、出資公示制度,督促出資人落實出資責(zé)任、履行出資義務(wù)、提高出資信用。四、努力營造良好的市場環(huán)境(十七)切實維護公平競爭的市場秩序。(十八)努力營造和諧的消費環(huán)境。有效保護外商投資企業(yè)商標(biāo)權(quán),繼續(xù)加快商標(biāo)注冊審查,加大商標(biāo)權(quán)保護力度。(二十)進一步提高行政許可效率。(二十一)積極促進廣告業(yè)健康發(fā)展。在嚴(yán)格依法行政的基礎(chǔ)上積極發(fā)揮行政指導(dǎo)的作用,采用建議、輔導(dǎo)、提醒、規(guī)勸、示范、公示等方式,提高行政指導(dǎo)效果。(二十四)進一步完善外商投資企業(yè)監(jiān)管長效機制。建立外商投資企業(yè)投訴受理工作機制。加大與相關(guān)部門的信息交流,形成服務(wù)外商投資企業(yè)健康發(fā)展的合力。the
