【正文】 根據(jù)我國《著作權(quán)法》錄音制品是聲音的錄制品，包括表演的聲音和其他聲音，其與錄像制品最大的不同是錄像制品有對畫面的錄制，而錄音制品只有對聲音的錄制；而《世界知識產(chǎn)權(quán)組織表演和錄音制品條約》，對錄音制品的解釋則更為嚴(yán)謹(jǐn)，首先排除“以電影作品或其他影像作品所含的錄制形式” ① ，定義的范圍更為全面。 ② 十二國著作權(quán)法翻譯組 .十二國著作權(quán)法 [M].北京 :清華大學(xué)出版社 ,.： 由系列相聯(lián)的圖像組 成的作品，這些圖像與配音（如有聲音）一起連續(xù)播放會生產(chǎn)一種動感 。 2. 視聽作品 1989 年 ，《 視聽作品國際注冊條約 》 ④ ，曾 試圖 統(tǒng)一 對錄像作品、電視作品 、電影作品 做出 不同 的 規(guī)定 ，認(rèn)為“ 視聽作品 意指由一系列相關(guān)的固定圖像 組成，帶有或不 帶伴音，能夠被看到的，并且?guī)в邪橐魰r，能夠被聽到的任何作品” 。 2 解釋進(jìn)行了擴(kuò)充，指出 包括“電影”、“電視劇”和“類似制作電影的方法創(chuàng)作的作品”三種作品 。 ③ 《 保護(hù)文學(xué)藝術(shù)作品伯爾尼公約 》 (Berne Convention for the Protection of Literary and Artistic Works)為 關(guān)于著作權(quán)保護(hù)的國際條約， 1886 年 9 月 9 日制定于瑞士伯爾尼，并分別于 1908 年 11 月 13 日（柏林）、 1928年 6 月 2 日（羅馬）、 1948 年 6 月 26 日（布魯塞爾）、 1967 年 7 月 14 日（斯德哥爾摩）、以及 1971 年 7月 24 日（巴黎）進(jìn)行修訂。這就使得在有關(guān)影視作品著作權(quán)侵權(quán)案件的判案過程中，法官缺乏法律依據(jù)，自主性較大，權(quán)利主體的合法權(quán)益難以得到保障。 因此，對影視作品著作權(quán)保護(hù)的研究也顯得極為重要。S REPUBLIC OF CHINA” in 1990, after the first revision in 2020, the second correction in 2020 and three times’ consultation for public opinion in March 2020, July 2020 and June 2020 respectively, the copyright protection of film and television works is gradually perfected regardless of some legal loopholes. The second section states the ownership of the film and television copyright in china.
