General一般條款1. Scope of Bid The World Health Organization, hereinafter the Employer, wishes to receive bids for the construction of a 400 Bed Hospital at Suleimaniyeh in Northern Iraq, hereinafter referred to as the Works,招標(biāo)范圍 世界衛(wèi)生組織，以下稱為“雇主”，期望能收到修建伊拉克北部蘇萊曼尼亞市400床位醫(yī)院的投標(biāo)書，以下簡稱為“本工程” The successful bidder will be expected to plete the Works within the period stated in the Appendix to Bid. 中標(biāo)人需要在標(biāo)書附頁所規(guī)定的工期內(nèi)完成本工程 Throughout these bidding documents, the terms bid and tender and their derivatives (bidder/tenderer, bid/tendered, bidding/tendering, etc.) are synonymous, and day means calendar day. Qualification Bidders shall, as part of their bid, submit in a separate folder marked “Qualification of the Bidder, the following documents: 作為標(biāo)書的一部分，投標(biāo)人應(yīng)該單獨(dú)提交裝在標(biāo)有“投標(biāo)人資質(zhì)”的文件袋里的 下列資質(zhì)文件： (a) A written power of attorney authorizing the signatory of the bid to mit the bidder。 （1）一份授權(quán)標(biāo)書簽字人代理履行投標(biāo)人義務(wù)的書面授權(quán)書。(b) The name of the pany, registered address, description, date established, years of experience as contractor, structure and organization, details of the number of technical, administrative and labour resources, details of contractor’s equipment and facilities。 （2）公司名稱，注冊(cè)地，公司介紹，成立日期，作為承包商有多少年的工程承包經(jīng)驗(yàn)，公司結(jié)構(gòu)和組織體系，技術(shù)人員，管理人員和勞動(dòng)力資源等詳細(xì)信息，承包商所擁有的設(shè)備及設(shè)施的詳細(xì)情況；(c) Registration certificates and certificates of good standing。 (3) 公司注冊(cè)證明文件和良好的信譽(yù)證明文件；(d) Statement confirming current ownership, directors and authorized executives。 （4）確認(rèn)當(dāng)前公司所有權(quán)，經(jīng)理和經(jīng)授權(quán)的執(zhí)行經(jīng)理（項(xiàng)目經(jīng)理）的申明書；(e) Audited accounts for the last 3 years。 （5） 最近3年來的審核賬目；(f) Bank statement confirming financial standing, access to lines of credit and availability of other financial resources。 用于證明公司財(cái)務(wù)狀況的銀行對(duì)賬單，獲得信用貸款的最高額度以及所擁有的其他金融資源。(g) Experience record including relevant projects pleted (name of project, location, employer, project value, year started, year pleted)。 （7）包括已竣工的類似工程在內(nèi)的業(yè)績證明（項(xiàng)目名稱，地點(diǎn)，雇主，項(xiàng)目造價(jià)，開工年份，竣工日期）(h) List of all projects in progress including name, location, employer, value, year stated and expected pletion date. （8）所有在建項(xiàng)目清單，包括項(xiàng)目名稱，地點(diǎn)，雇主，造價(jià)，開工年份和預(yù)期的竣工日期。All above documents shall be in English or, where the original document is in any other language, it shall be acpanied by any official English translation. 以上所有文件應(yīng)以英語書寫或者，若原始文件使用其他任何一種語言，這些文件應(yīng)附上正式的英語翻譯。 Bids submitted by a joint venture of two or more firms as partners shall ply with the following requirements: 由兩個(gè)公司或兩個(gè)以上合作伙伴公司組成的聯(lián)合體提的標(biāo)書應(yīng)滿足下列要求。(a) The bid shall include all the information listed in SubClause above。 （1）。(b) The bid and, in case of a successful bid, the Agreement, shall be signed so as to be legally binding on all partners。 （2）若聯(lián)合體中標(biāo)，則所簽署的標(biāo)書和協(xié)議對(duì)所有合伙公司都具有法律約束力；(c) One of the partners shall be nominated as being in charge, and this authorization shall be evidenced by submitting a power of attorney signed by legally authorized signatories of all the partners。 （3）應(yīng)提名合伙公司其中之一作為主承包商，同時(shí)應(yīng)通過提交所有合作伙伴法定授權(quán)簽字人簽字的授權(quán)書來證明這種授權(quán)委托關(guān)系；(d) The partner in charge shall be authorized to incur liabilities and receive instructions for and on behalf of any and all partners of the joint venture and the entire execution of the contract, including payment, shall be done exclusively with the partner in charge。 （4）所有合伙公司應(yīng)授權(quán)這個(gè)主管公司代表聯(lián)合體內(nèi)的任意或所有公司承擔(dān)責(zé)任或接受指令，并且只能由該主管公司來執(zhí)行包括支取工程款在內(nèi)的整個(gè)合同內(nèi)容；(e) All partners of the joint venture shall be liable jointly and severally for the execution of the contract in accordance with the contract terms, and a statement to this effect shall be included in the authorization mentioned under (c) above, as well as in the bid and in the Agreement (in case of a successful bid)。 and (5) 聯(lián)合體內(nèi)的所有合伙公司都對(duì)依照合同條款來執(zhí)行合同負(fù)有連帶責(zé)任，對(duì)于此項(xiàng)連帶責(zé)任的申明應(yīng)在上文（c）款中提及的授權(quán)書中寫明，也應(yīng)在投標(biāo)書和協(xié)議書中寫明此項(xiàng)責(zé)任（如果中標(biāo)的話）(f) A copy of the agreement entered into by the joint venture partners shall be submitted with the bid. （6）聯(lián)合體合作伙伴之間簽訂的協(xié)議書副本應(yīng)與投標(biāo)書一起提交3. One Bid per Each bidder shall submit only one bid either by Bidder himself, or as a partner in a joint venture.
