【正文】 . . . .. .Contractor HSE AgreementxxxxxxxxxxxxxxxxxxxxxManufacturing Factories in xxxxxxxxxxxxxxxx生產(chǎn)制造工廠承包商環(huán)境健康安全協(xié)議書Party A:甲方： PartyB: d.乙方： Party A and Party B hereby reach a consensus after negotiation to enter into this contractor safety agreement (hereinafter referred to as the Agreement) to ensure smooth progress of the projects (. engineering construction/site services/internal transportation, etc., and for specific projects and scope of works, the purchase agreement (hereinafter referred to as the Purchase Agreement)between the partiesshall prevail) undertaken by the contractor and to safeguard the life and properties of the parties and satisfythe requirements for environmental protection. If Party B is entitled to subcontract the works missioned by Party A according to the provisions of Purchase Agreement, then the contents hereof apply equally to its subcontractors and their employees. In this case, Party B is obliged to ensure its subcontractors and their employees ply with this agreement and shall bear the liabilities toParty A for any breach of the agreementmitted by Party B’ssubcontractors and their employees.為保證乙方所承包項(xiàng)目（如工程施工/現(xiàn)場(chǎng)服務(wù)/內(nèi)部運(yùn)輸?shù)?，具體承包項(xiàng)目及承包內(nèi)容以甲、乙雙方簽署的采購協(xié)議（以下簡(jiǎn)稱“采購協(xié)議”）為準(zhǔn)）的順利進(jìn)行，確保甲、乙雙方生命、財(cái)產(chǎn)安全以及滿足環(huán)境保護(hù)的要求，經(jīng)雙方協(xié)商一致同意簽訂本承包商安全協(xié)議書（以下簡(jiǎn)稱“協(xié)議書”）。若根據(jù)采購協(xié)議的規(guī)定，乙方有權(quán)將甲方所委托工作進(jìn)行轉(zhuǎn)包，則本協(xié)議內(nèi)容一并適用于其分包商及分包商的員工。在此情況下，乙方有義務(wù)確保其分包商及分包商的員工遵守本協(xié)議，并應(yīng)就其分包商及分包商的員工對(duì)本協(xié)議的違反向甲方承擔(dān)違約責(zé)任。1 General總則 The personnel of Party B who are entering into Party A39。s facilities for relevant works must strictly abide by all HSE rules and regulations of Party A.2 乙方人員需要進(jìn)入甲方進(jìn)行相關(guān)工作時(shí)，必須嚴(yán)格遵守甲方的各項(xiàng)環(huán)境健康安全規(guī)章制度。 Party B must provide its employees and its subcontractors with safetyoperation tools and sufficient HSErelated facilities and articles such as proper PPE and clean drinking water, etc. It is strictly prohibited to bring foods or drinking water to the construction site.乙方必須為自己的員工以及分包商提供安全的作業(yè)工具、足夠的環(huán)境健康安全相關(guān)設(shè)施及用品，如合適的勞動(dòng)防護(hù)用品、清潔的飲用水等。食品、飲用水嚴(yán)禁帶入施工現(xiàn)場(chǎng)。 All persons of Party B who are going to provide services officially must be subject to the HSE training and assessment organizedby Party A, and only after assessment resultis acceptable can they mence their HSE safety education, training and assessment provided by Party A to the personnel of Party B shall not relieve Party B from its obligations and responsibilities hereunder or under the Purchase Agreement. Party B shall notify Party A of thecontents and form of works in advance.乙方所有人員在正式提供服務(wù)前，必須接受甲方安排的環(huán)境健康安全教育培訓(xùn)和考核，合格后方可開始作業(yè)。甲方對(duì)乙方人員的環(huán)境健康安全教育培訓(xùn)和考核對(duì)乙方基于本協(xié)議或采購協(xié)議中應(yīng)承擔(dān)的義務(wù)和責(zé)任不構(gòu)成任何影響。乙方應(yīng)就作業(yè)內(nèi)容及形式事先通知甲方。 Party B shall solely bear all expenses incurred as a result of any accident or casualty caused by Party B’sviolation of HSE rules and regulations of the government and the HSE requirements of Party A, and Party A is also entitled to further claim the liabilities of Party B shallnot violate the HSE rules amp。 regulations and HSE requirements of Party A/the governmentno matter with whatsoever excuse.乙方違反政府的環(huán)境健康安全規(guī)章制度和甲方環(huán)境健康安全要求而造成的任何事故或人員傷害，所發(fā)生的全部費(fèi)用均由乙方自行承擔(dān)，并且甲方有進(jìn)一步追究責(zé)任的權(quán)力。乙方不得以任何理由違反甲方/政府的環(huán)境健康安全規(guī)章制度和環(huán)境健康安全要求。 Party B must provide cooperation during the site supervision and inspection conducted by Party A andshallaccept any penalty imposedagainst itdue to its violation of the HSE rules of Vestas. The site supervision and inspection conducted by Party A with respect to Party B shall not reliev
