【正文】 畢 業(yè) 論 文 題 目 ： 淺論我國(guó)精神損害賠償制度的完善 系 別： 人 文 社 科 系 專 業(yè)： 法 學(xué) 班 級(jí)： 學(xué)生姓名： 學(xué) 號(hào)： 指導(dǎo)教師： 摘要 隨著 社會(huì)文明程度 的日漸 提高 ， 我國(guó)民主、法制化進(jìn)程 的 逐漸 推進(jìn)，人們對(duì)精神利益的自我保護(hù)意識(shí) 不斷 強(qiáng) 化，精神損害賠償問題 日益 成 為 眾人矚目的焦點(diǎn) 。然而， 目前的法律法規(guī)和司法解釋對(duì)精神損害賠償相關(guān)問題的規(guī)定還不夠完善， 導(dǎo)致 精神損害賠償制度在 司法實(shí)踐中的適用極其不統(tǒng)一。 本文以精神損害的定義、內(nèi)涵為切入點(diǎn)，全面回顧我國(guó)精神損害賠償制度發(fā)展的歷史，分析和比較國(guó)內(nèi)外的精神損害賠償制度，結(jié)合 我國(guó)精神損害賠償?shù)默F(xiàn)狀 ，剖析其立法和司法缺陷， 進(jìn)而提出完善建議 。 關(guān)鍵詞 ： 精神損害 ； 賠償 ； 適用范圍 ； 完善 Abstract With the improvement in the level of social civilization and our democracy and legal process moves forward, people’s sense of selfprotection on the interests of the spirit continued to strengthen, and mental damages has increasingly bee a focus of attention. However, the current laws, regulations and judicial interpretation of laws related issues for mental damages provision are not enough to improve。 resulting in the application of the Spirit Injury Compensation in judicial practice is extremely nonuniform. This paper makes the definition and meaning of mental injury as the entry point, prehensively review of the system of pensation for the development of moral damage histories. In addition, it analyses and pares the moral damage pensation system between the domestic institutions and foreign systems. Combined with the implementation of the pensation for moral damages in our current situation, this paper analyzes the legislative and judicial shortings and thus to put forward a sound proposal.
