方另行安排的工作的; 乙方不能勝任工作,經(jīng)過調(diào)整工作崗位,仍不能勝任工作的; 本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,經(jīng)甲、乙雙方協(xié)商,未能變更本合同內(nèi)容達成協(xié)議的; 按照相關(guān)法規(guī)及程序甲方依法裁員的。第二十四條 乙方有下列情形之一的,甲方不得按本合同第二十四條的約定與乙方解除勞動和同: 在甲方工作期間患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者部分喪失勞動能力的; 患病或因工負(fù)傷,在規(guī)定的醫(yī)療期間的; 女職工在孕期、產(chǎn)期、哺乳期的; 法律、行政法規(guī)規(guī)定的其他情形。第二十五條 符合下列情形之一的,本勞動合同即可終止: 勞動合同期滿; 乙方死亡、或者被法院宣告死亡或者宣告失蹤的; 甲方依法被宣告破產(chǎn)的; 甲方被吊銷營業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者甲方?jīng)Q定提前解散的; 法律、行政法規(guī)規(guī)定的其他情形。九、賠償責(zé)任、違約責(zé)任第二十六條 乙方未能提前書面提出解除勞動合同的賠償金:未按照《勞動合同法》提前三十日書面形式通知甲方解除勞動合同,需按照乙方日工資的標(biāo)準(zhǔn)來補足時間的賠償。第二十七條 乙方造成直接損失的賠償金:賠償金按乙方實際造成的損失計算,賠償金的范圍包括: 乙方損壞甲方財物而導(dǎo)致的直接經(jīng)濟損失; 乙方疏忽導(dǎo)致的甲方直接經(jīng)濟損失; 乙方拒絕合理的工作安排而導(dǎo)致甲方經(jīng)濟損失。第二十八條 甲方根據(jù)乙方的要求出資為乙方辦理了外省市專業(yè)技術(shù)人員、管理人員的調(diào)動引進手續(xù),在入戶手續(xù)完畢后,必須在本公司服務(wù)期滿 年。服務(wù)期內(nèi),乙方不得提出辭職解除合同。若在服務(wù)期內(nèi)自行離開公司或違紀(jì)被甲方解除合同的,按 元人民幣的賠償額,根據(jù)乙方未服務(wù)滿的年限,按比例折算(年平均賠償金額)賠償。 第二十九條 甲乙雙方任何一方違反本合同,給另一方造成經(jīng)濟損失的,根據(jù)違約者責(zé)任大小,需承擔(dān)違約責(zé)任。第三十條 乙方不得在任何情況下將甲方的保密資料直接或者間接泄露給任何外人,如經(jīng)甲方發(fā)現(xiàn)按甲方損失大小賠償。十、勞動爭議的處理第三十一條 甲乙雙方協(xié)商解決。第三十二條 甲乙雙方協(xié)商不成,可由爭議的一方申請勞動仲裁。十一、其他第三十三條 本合同未盡事宜,按國家和當(dāng)?shù)卣嘘P(guān)法律、法規(guī)規(guī)定辦理。第三十四條 從本合同簽訂生效之日起,原合同即日廢止。第三十五條 本合同一式兩份,甲乙雙方各執(zhí)一份,經(jīng)甲乙雙方簽字蓋章后生效。兩份合同具同等法律效力。甲方: 乙方:(簽字)法定代表人或委托代理人:(簽字或蓋章) 簽訂日期: 年 月 日 簽訂日期: 年 月 日 Labor ContractDate:Party A(Employer):Name: Legal Representative: Address: Party B (Employee):Gender:Date of Birth:ID Card No.:Domicile:Contact:Address:The contract is hereby concluded by both parties in accordance with Labor Law of the People39。s Republic of China, Labor Contract Law of the People’s Republic of China, and Regulations of Shanghai Municipality on Labor Contract, in the principles of fairness, legitimacy, equality, voluntariness, consensus through negotiation and good faith. 1.
