Project’s List and Quantity List, make pletion of any and all items of tunnel construction including execution, pletion and defect’s repair.六、工程質(zhì)量標(biāo)準(zhǔn)與驗(yàn)收 Project Quality Standards and Acceptance乙方必須嚴(yán)格按照甲方技術(shù)交底、現(xiàn)行鐵路驗(yàn)收標(biāo)準(zhǔn)和鐵路施工規(guī)范組織施工。乙方所承包的工程，必須達(dá)到國家或本行業(yè)現(xiàn)行的工程質(zhì)量驗(yàn)收標(biāo)準(zhǔn)。Party B should, in strict conformity with party A’s technical direction and existing railway acceptance standard / norm, carry out execution hereof. The project contracted by party B should satisfy to the acceptance standard which are stipulated by state or industry.凡因乙方原因造成的施工質(zhì)量不合格的工程，乙方應(yīng)在規(guī)定的時(shí)間內(nèi)無償進(jìn)行返工，如果返工后仍達(dá)不到驗(yàn)收標(biāo)準(zhǔn)的，甲方有權(quán)委派其它單位或個(gè)人進(jìn)行整修，費(fèi)用由乙方承擔(dān)。Provided that any defect / unqualified work in project execution due to party B, rework should be carried out by party B in free, where the rework is still not satisfy acceptance standard, party A is entitle to dispatch other contractor or individual to conduct repair for which the cost will be on party B’s account.七、隱蔽工程檢查和簽證 Inspection and Confirmation of Hidden Works甲方質(zhì)檢人員在對(duì)隱蔽工程檢查前，乙方應(yīng)進(jìn)行嚴(yán)格的自行檢查。Respect to hidden work party B should conduct selfstrict exam before the inspection by party A’s quality inspector.乙方每進(jìn)行一道工序施工前，必須及時(shí)通知甲方，對(duì)上道工序完成工程量的確認(rèn)。Party B should, prior to conduct next work procedure, give notice timely to party A for confirmation of the pletion quantity in ahead procedure.八、材料的供應(yīng) Supply of Material甲方提供給乙方材料單價(jià)：主要材料按市場(chǎng)價(jià)格執(zhí)行，其他非甲方供應(yīng)材料由乙方自行采購，質(zhì)量滿足相應(yīng)標(biāo)準(zhǔn)。The price of materials which are supplied by party A to party B: main materials will be subject to marked price, other nonparty A’s provision of materials, the quality thereof should be satisfaction with corresponding standards, will be purchased by party B itself.九、工程變更 Alteration建設(shè)單位和甲方對(duì)原工程設(shè)計(jì)進(jìn)行的變更，乙方必須服從。Any alteration to original design by employer and / or party A should be conformed with by party B.因變更延誤的工期經(jīng)甲方批準(zhǔn)后相應(yīng)順延。The delayed term due to alteration may, be subject to party A’s approval, be allowed corresponding extension.由于變更引起工程量的增減，按照附件1 的單價(jià)執(zhí)行，但是涉及工程項(xiàng)目增加的，雙方另行協(xié)商確定單價(jià)。Addition / deduction of engineering due to alteration will be executed pursuant to the stipulations of appendix One, provided that respect with addition of project item, the price thereof will be otherwise greed by parties.十、雙方責(zé)任與權(quán)利 Responsibilities and Rights of Parties甲方責(zé)任與權(quán)利 Responsibilities and Rights of Party A(1) 負(fù)責(zé)解決施工場(chǎng)地的征用，工程用電主線提供至施工現(xiàn)場(chǎng)。Responsible for requisition of construction site and provision of power line for project to site. (2) 甲方負(fù)責(zé)對(duì)工程進(jìn)行技術(shù)交底，負(fù)責(zé)隧道主體的線形控制。Responsible for technical explanation and linear control of tunnel main constructure.（3) 負(fù)責(zé)技術(shù)監(jiān)督、檢查工作，甲方技術(shù)人員有權(quán)對(duì)乙方不合格工程責(zé)令返工，對(duì)乙方提供的施工原始資料進(jìn)行審核。Responsible for technical supervision and inspection, party A’s technician is entitle to give order of rework for party B’s any unqualified project in addition to original data on project which are provided by party B.乙方責(zé)任與權(quán)利 Liabilities and Rights of Party B(1) 完成本合同承包范圍項(xiàng)目工程及附屬的施工、竣工和缺陷修復(fù)工作。To plete the project works in contracting scope hereof and the execution, pletion and defect repair of auxiliary works.(2)嚴(yán)格按照施工圖紙、《鐵路隧道施工規(guī)范》及鐵路工程有關(guān)的其他技術(shù)規(guī)范和甲方技術(shù)交底進(jìn)行施工，確保工程質(zhì)量。To carry out construction and ensure project quality in accordance with executing drawings, Norm of Railway Tunnel Construction and other technical norms relevant to railway engineering in addition to party A’s technical explanation.(3) 作好施工原始記錄和編制甲方需要的全部施工資料交甲方存檔。To make original records of execution which are party A’s necessity and refer the same to party A for archiving.十一、安全施工 Safe Construction乙方在施工中必須嚴(yán)格按施工技術(shù)規(guī)范、操作步驟及安全保護(hù)措施進(jìn)行施工生產(chǎn)，如果由于乙方原因造成的人員傷亡和財(cái)產(chǎn)損失等事故，一切責(zé)任和后果均由乙方承擔(dān)。Party B should in strict accordance with norm of construction technology, operation procedure and safe protection measure, carry out execution, where any accidents of personal casualties or properties loss due to party B, all liabilities and consequence arising therefrom will be undertaken by party B.爆破用炸藥、雷管由甲方安排供應(yīng)，乙方必須安排專用存放地點(diǎn)，安排專人負(fù)責(zé)炸藥、雷管的接收、保管工作。如果因乙方原因造成炸藥、雷管丟失、被盜等，所造成的一切后果和損失，均由乙方負(fù)責(zé)。The explosive and detonator for blasting work will be supplied by party A, and party B should prepare special place and assign particular person to take charge of receipt and custody of explosive and detonator, where any losing or stealing thereof due to party B, the any consequence or loss arising therefrom will be responsible on party B.十二、進(jìn)度計(jì)劃 Progress Schedule經(jīng)甲乙雙方同意的施工進(jìn)度計(jì)劃，是本合同的組成部分，雙方必須遵守。Parties hereto should conform with the progress schedule which is agreed by parties and being the integral part of this contract.乙方必須按照上報(bào)甲方的施工組織設(shè)計(jì)方案進(jìn)行施工，嚴(yán)格執(zhí)行進(jìn)度計(jì)劃，如果由于乙方原因造成進(jìn)度滯后，乙方應(yīng)當(dāng)及時(shí)調(diào)整施工計(jì)劃，確保施工進(jìn)度。Party B should in accordance with Design Schedule of Construction Organization, conduct in strict progress plan, where any progress delay occur due to party B, the adjustment of execution should be make for ensure project progress.十三、承包工程價(jià)款支付和結(jié)算 Settlement and Payment甲方不撥預(yù)付款，根據(jù)實(shí)際完成情況，按本合同第四條規(guī)定每月甲方根據(jù)由項(xiàng)目總工審核批準(zhǔn)的工程量核定工程價(jià)款。每次應(yīng)付金額為其驗(yàn)工計(jì)價(jià)的80%，同時(shí)扣減甲方供應(yīng)的材料及提供的水電費(fèi)；扣留20%作為工程質(zhì)量保證金。No advance payment will be paid by party A. Project cost will, pursuant to actual pletion and stipulation of Article Four hereof, be approved by party A at each month subject to the project quantity which has been confirmed by the project’s general engineer.
