The department that receives the report shall handle it within its scope of duties and responsibilities in a timely manner.Article 9 The State encourages and promotes the research and development and application of new technologies for pipeline protection.Chapter II Planning and Construction of PipelinesArticle 10 The planning and construction of pipelines shall satisfy the requirements of pipeline protection and ply with the principles of safety, environmental protection, conservative use of land, and economical reasonableness.Article 11 The department in charge of energy under the State Council shall organize the formulation of national pipeline development planning according to the needs of national economic and social development. It shall solicit opinions from the relevant departments under the State Council and the people39。s governments of the provinces, autonomous regions, and municipalities directly under the Central Government for formulating the national pipeline development planning.The national pipeline development planning shall conform to the national energy planning, and be in harmony with the overall land use planning, urban and rural planning, and planning related to mineral resources, environmental protection, water resources, railway, highway, channel, port, telemunications, etc.Article 12 A pipeline enterprise shall formulate a pipeline construction planning in accordance with the national pipeline development planning, and submit the pipeline construction route selection plan determined in its pipeline construction planning to the urban and rural planning department under the local people39。s government at or above the county level where the pipelines are to be constructed. If the route plies with the urban and rural planning, the pipeline route selection plan shall be included into the local urban and rural planning.Land used for pipeline construction that has been included into the urban and rural planning shall not be used for other purposes arbitrarily.Article 13 The selection of a pipeline construction route shall avoid areas of seismically active faults and areas prone to floods or geological disasters, and keep a distance, which is mandatorily required by this Law, the relevant laws and administrative regulations, and the technical criteria of the State, away from buildings, structures, railways, highways, channels, ports, municipal facilities, military facilities, electric cables, optical cables, etc.If the areas where newlyconstructed pipelines pass through fail to satisfy the pipeline protection requirements specified in the preceding paragraph due to geographical limitations, the pipeline enterprise shall make a protection plan and have it reviewed by pipeline protection experts through deliberation, and report the same to the relevant department in charge of pipeline protection under the local people39。s governments at or above the county level for approval, and can then mence the construction.內(nèi)容總結(jié)
