【正文】 在下列情況下，投標(biāo)保證金將被貴方?jīng)]收：a. 投標(biāo)人在招標(biāo)文件中規(guī)定的投標(biāo)截止日期后投標(biāo)有效期內(nèi)撤回其投標(biāo)；b. 投標(biāo)人在投標(biāo)截止日期后對投標(biāo)文件作實質(zhì)性修改的；c. 投標(biāo)人不接受本須知對計算錯誤的修正；d. 投標(biāo)人有腐敗和欺詐行為的；e. 中標(biāo)人未能根據(jù)規(guī)定簽署合同；f. 合同簽署后，中標(biāo)人未能按規(guī)定提交履約保證金；g. 中標(biāo)人未能按本須知第3條的規(guī)定支付中標(biāo)服務(wù)費。 neither party shall seek recourse to court or other authorities for revising the decision. The arbitration fee shall be borne by the losing party.(19) 稅費 TAXES AND DUTIES:根據(jù)稅法規(guī)定，由中國政府向買方征收的執(zhí)行合同的稅費由買方負(fù)擔(dān)。如果累計的違約金超過合同總價的15%，買方有權(quán)終止部分或全部合同而不給賣方以任何補償。對于急需的設(shè)備，賣方應(yīng)自負(fù)費用將其用最快的運輸方式運到工作現(xiàn)場。The details of technical specifications and technical documents refers to Annex 3.(12) 裝運通知 Shipping Advice：賣方應(yīng)于裝船后3天內(nèi)，立即將船名、提單號、裝運日期、合同編號、商品名稱、數(shù)量、重量、貨物金額、裝運港及目的港傳真給買方。90% of the total contract value shall be made by an Irrevocable Letter of Credit at sight (which is opened by a main bank in China 30 days before shipment, in favor of the Seller and in the amount of USD ), upon the receipt by the Buyer of the following documents provided they are in order：a) 已裝運清潔提單，空白抬頭，空白背書，注明“運費預(yù)付”并通知目的港的國電物資集團有限公司(三份正本三份副本)。The Seller shall be responsible for booking shipping space and arranging the shipment and pay for the freight.不允許轉(zhuǎn)船。One (1)original and one(1) copy of Insurance policy with the Buyer as beneficiary covering 110% of the proforma invoice value, showing claims payable in destination, in currency of the contract, blank endorsed, covering Ocean marine/All Risk amp。賣方有責(zé)任處理在保證期以后發(fā)現(xiàn)的任何貨物因設(shè)計或制造引起的缺陷。B）In case the Seller fails to make delivery pursuant to the Final Delivery Schedule, the Seller shall pay the liquidated damages for late delivery at the following rates:1) From the first to the fourth week, the liquidated damage shall be one percent (%) of the value of the delayed Contract Equipment per week. 2) From the fifth to the eighth week, the liquidated damage shall be one point five percent (%) of the value of the delayed Contract Equipment per week.3) After the ninth week, the liquidated damage shall be two percent (%) of the value of the delayed Contract Equipment per week.The payment of liquidated damages shall not release the Seller from its obligation to deliver the delayed Contract Equipment.C. 賣方應(yīng)按照本合同附件3規(guī)定的計劃交付技術(shù)資料。Majeure means the event that the parties could not foresee at the time of conclusion of the Contract and its occurrence and consequences cannot be avoided and cannot be overe, such as war, serious fire, flood, typhoon and earthquake and other cases. If either of the parties to the Contract be prevented from executing the Contract by Force Majeure, the time for execution of the contract shall be extended by a period equal to the effect of these causes.
