【正文】 ] 可見我國對中小企業(yè)的界定標(biāo)準(zhǔn)主要是根據(jù)企業(yè)的職工人數(shù)，資產(chǎn)總額和銷售收入等指 標(biāo)進(jìn)行劃分的。批發(fā)業(yè)中小型企業(yè)須符合以下條件：職工人數(shù) 200 人以下，或銷售額 30000 萬元以下。中小企業(yè)是與大企業(yè)相對而言，由于不同的國家具有不同的國情，各國對中小企業(yè)的劃分標(biāo)準(zhǔn)也不盡相同。 有研究稱， 小企業(yè)主的收入水平與其雇員的收入水平差別不會太大，發(fā)展小企業(yè)有助于防止收入兩極分化，維護(hù)社會公平。 本文通過分析我國小 企業(yè)的 發(fā)展 現(xiàn)狀，評價(jià)國家關(guān)于小企業(yè) 發(fā)展 的政策 、 法律及其實(shí)際效果，指出我國小 企業(yè)發(fā)展 所面臨的瓶頸及主要問題，提出國家應(yīng)該把現(xiàn)有的規(guī)定落到實(shí)處，同時(shí)制定更具體明確的支持小企業(yè) 發(fā)展 的 法律、 政策，并提出了通過修改 完善 《擔(dān)保法》、 《 小企業(yè)促進(jìn)法 》、 制定專門的《 中小企業(yè)金融 法》 、《融資租賃法》 來切實(shí)解決小企業(yè)融資難的方案及立法建議。目前，從農(nóng)村轉(zhuǎn)移出來的勞動力有 70%以上是在小企業(yè)就業(yè)。其中，中型企業(yè)必須同時(shí)滿足職工人數(shù) 600 人及以上，銷售額 3000 萬元及以上，資產(chǎn)總額4000 萬元及以上；其余為小型企業(yè)。其中，中型企業(yè)必須同時(shí)滿足職工人數(shù) 400 人及以上，銷售額 3000 萬元及以上；其余為小型企業(yè)。 目前，很多私營小企業(yè)仍實(shí)行家族式管理的企業(yè)治理結(jié)構(gòu) ， 國有小企業(yè)的治理結(jié)構(gòu)與傳統(tǒng)的大型國有企業(yè)沒有什么本質(zhì)的差別 ， 一部分鄉(xiāng)鎮(zhèn)集體企業(yè)具有老國企的弊端，一部分演變成家族式企業(yè)。 ⑤ 在全球化和知識化浪潮中新出現(xiàn)的高度專業(yè)化，創(chuàng)新型的高技術(shù)研究開發(fā)企業(yè)及將已有科研成果轉(zhuǎn)向生產(chǎn)的高品化，市場化，產(chǎn)業(yè)化的小企業(yè)。 近年來中國政府完善小企業(yè)發(fā)展法律環(huán)境的具體措施 ① 抓緊落 實(shí)配套的行政法規(guī)、規(guī)章與實(shí)施細(xì)則。目前，全國已設(shè)立中小企業(yè)擔(dān)保機(jī)構(gòu) 2188 家，累計(jì)受保企業(yè)達(dá) 19 萬戶，累計(jì)擔(dān)保金額約 3000 多億元。對 萬戶小企業(yè)開展了信用等級評價(jià)和信用信息征集。 （ 2） 是缺乏平等、透明的法律環(huán)境。 （ 4） 是融資法律環(huán)境障礙造成融資難。 （ 6） 是負(fù)擔(dān)重。這也是市場經(jīng)濟(jì)和法治社會的要求。 （ 2）完善小企業(yè)發(fā)展的市場經(jīng)濟(jì)基礎(chǔ)法律――民法與商法系統(tǒng)。 以貫徹《中華人民共和國行政許可法》和《全面推進(jìn)依法行政實(shí)施綱要》為契機(jī)，推進(jìn)依法行政。銀行要依法運(yùn) 營，不應(yīng)違反合同法隨意提前收回貸款。 [10]根據(jù)小規(guī)模納稅人的實(shí)際負(fù)擔(dān)能力，降低小規(guī)模納稅人增值稅征收率。就法律環(huán)境而言，在申請加入世界貿(mào)易組織過程中，尤其是在成功加入之后，我國政府各級立法部門制定的各種促進(jìn)小企業(yè)發(fā)展的法律法規(guī)及行政規(guī)章都將大大促進(jìn)小企業(yè)的良性發(fā)展。 [2] 劉東濤 、 周序中 ： 完善中小企業(yè)健康發(fā)展的法律環(huán)境 [J]， 中國商貿(mào) ， 2022 年1 月 。 [10]李善山 ： 對中小企業(yè)發(fā)展的財(cái)稅政策改革的思考 [M]， 海南出版社 ， 2022 年 7 月 。s Day.
