Article 9 To apply for the qualification for engaging in the storage business of refined oil, an enterprise shall satisfy the conditions as follows: (1) it shall have a refined oil depot whose capacity shall be larger than 10,000 steres and whose construction shall abide by the local urban and rural planning and oil depot layout planning。 (4) it must have a refined oil depot whose capacity shall be larger than 10,000 m3 and whose construction shall abide by the local urban and rural planning and oil depot layout planning。s governments in each province, autonomous region, municipality directly under the central government and city specifically designated in the state plan (hereinafter referred to as the administrative departments of merce of the provincial people39。 第四十四條 企業(yè)申請從事成品油經(jīng)營有下列行為之一的,商務(wù)主管部門應(yīng)當(dāng)作出不予受理或者不予許可的決定,并給予警告;申請人在一年內(nèi)不得為同一事項(xiàng)再次申請成品油經(jīng)營許可。 第三十九條 成品油零售企業(yè)應(yīng)當(dāng)從具有成品油批發(fā)經(jīng)營資格的企業(yè)購進(jìn)成品油。無故不辦理停歇業(yè)手續(xù)或停歇業(yè)超過規(guī)定期限的,由發(fā)證機(jī)關(guān)撤銷其成品油經(jīng)營許可,注銷成品油經(jīng)營批準(zhǔn)證書,并通知有關(guān)部門。 第二十九條 成品油經(jīng)營企業(yè)要求變更成品油經(jīng)營批準(zhǔn)證書有關(guān)事項(xiàng)的,應(yīng)向申請部門提交下列文件: 經(jīng)營單位投資主體未發(fā)生變化的,屬企業(yè)名稱變更的,應(yīng)當(dāng)提供工商行政管理部門出具的《企業(yè)名稱預(yù)先核準(zhǔn)通知書》或船籍管理部門的船舶名稱變更證明;屬法定代表人變更的,應(yīng)附任職證明和新的法定代表人身份證明;不涉及油庫和加油站遷移的經(jīng)營地址變更,應(yīng)提供經(jīng)營場所合法使用權(quán)證明。 第二十六條 成品油經(jīng)營企業(yè)設(shè)立經(jīng)營成品油的分支機(jī)構(gòu),應(yīng)按照本辦法規(guī)定,另行辦理申請手續(xù)。對(duì)符合本辦法第八條規(guī)定條件的,應(yīng)當(dāng)給予成品油零售經(jīng)營許可,并頒發(fā)《成品油零售經(jīng)營批準(zhǔn)證書》;對(duì)不符合條件的,將不予許可的決定及理由書面通知申請人。 不受理成品油經(jīng)營許可申請,應(yīng)當(dāng)出具加蓋本行政機(jī)關(guān)專用印章、說明不受理理由和注明日期的書面憑證,并告知申請人享有依法申請行政復(fù)議或者提起行政訴訟的權(quán)利。 水上加油站(船)還需提供水域監(jiān)管部門簽署的《加油船經(jīng)營條件審核意見書》。 第八條 申請成品油零售經(jīng)營資格的企業(yè),應(yīng)當(dāng)具備下列條件: (一) 符合當(dāng)?shù)丶佑驼拘袠I(yè)發(fā)展規(guī)劃和相關(guān)技術(shù)規(guī)范要求; (二) 具有長期、穩(wěn)定的成品油供應(yīng)渠道,與具有成品油批發(fā)經(jīng)營資格的企業(yè)簽訂3年以上的與其經(jīng)營規(guī)模相適應(yīng)的成品油供油協(xié)議; (三) 加油站的設(shè)計(jì)、施工符合相應(yīng)的國家標(biāo)準(zhǔn),并通過國土資源、規(guī)劃建設(shè)、安全監(jiān)管、公安消防、環(huán)境保護(hù)、氣象、質(zhì)檢等部門的驗(yàn)收; (四) 具有成品油檢驗(yàn)、計(jì)量、儲(chǔ)運(yùn)、消防、安全生產(chǎn)等專業(yè)技術(shù)人員; (五) 從事船用成品油供應(yīng)經(jīng)營的水上加油站(船)和岸基加油站(點(diǎn)),除符合上述規(guī)定外,還應(yīng)當(dāng)符合港口、水上交通安全和防止水域污染等有關(guān)規(guī)定; (六) 面向農(nóng)村、只銷售柴油的加油點(diǎn),省級(jí)人民政府商務(wù)主管部門可根據(jù)本辦法規(guī)定具體的設(shè)立條件。 商務(wù)部負(fù)責(zé)起草成品油市場管理的法律法規(guī),擬定部門規(guī)章并組織實(shí)施,依法對(duì)全國成品油市場進(jìn)行監(jiān)督管理。 省、自治區(qū)、直轄市及計(jì)劃單列市人民政府商務(wù)主管部門(以下簡稱省級(jí)人民政府商務(wù)主管部門)負(fù)責(zé)制定本轄區(qū)內(nèi)加油站和倉儲(chǔ)行業(yè)發(fā)展規(guī)劃,組織協(xié)調(diào)本轄區(qū)內(nèi)成品油經(jīng)營活動(dòng)的監(jiān)督管理。 第九條 申請成品油倉儲(chǔ)經(jīng)營資格的企業(yè),應(yīng)當(dāng)具備下列條件: (一) 擁有庫容不低于10000立方米的成品油油庫,油庫建設(shè)符合城鄉(xiāng)規(guī)劃、油庫布局規(guī)劃;并通過國土資源、規(guī)劃建設(shè)、安全監(jiān)管、公安消防、環(huán)境保護(hù)、氣象、質(zhì)檢等部門的驗(yàn)收; (二) 申請主體應(yīng)具有中國企業(yè)法人資格,且注冊資本不低于1000萬元人民幣; (三) 擁有接卸成品油的輸送管道或鐵路專用線或公路運(yùn)輸車輛或1萬噸以上的成品油水運(yùn)碼頭等設(shè)施; (四) 申請主體是中國企業(yè)法人分支機(jī)構(gòu)的,其法人應(yīng)具有成品油倉儲(chǔ)經(jīng)營資格。 第十四條 申請從事成品油倉儲(chǔ)經(jīng)營資格的企業(yè),除提交本辦法第十一條規(guī)定的文件外,還應(yīng)當(dāng)提交省級(jí)人民政府商務(wù)主管部門核發(fā)的油庫規(guī)劃確認(rèn)文件。 第十八條 受理申請的商務(wù)主管部門應(yīng)當(dāng)對(duì)申請人提交的材料認(rèn)真審核,提出處理意見。 第二十一條 成品油批發(fā)、倉儲(chǔ)經(jīng)營企業(yè)進(jìn)行新建、遷建、擴(kuò)建油庫等倉儲(chǔ)設(shè)施,須符合城鄉(xiāng)規(guī)劃、油庫布局規(guī)劃,在取得省級(jí)人民政府商務(wù)主管部門核發(fā)的油庫規(guī)劃確認(rèn)文件,并辦理相關(guān)部門驗(yàn)收手續(xù)后,報(bào)商務(wù)部備案。 第四章 成品油經(jīng)營批準(zhǔn)證書的頒發(fā)與變更 第二十七條 成品油經(jīng)營批準(zhǔn)證書由商務(wù)部統(tǒng)一印制。 經(jīng)營單位投資主體發(fā)生變化的,原經(jīng)營單位應(yīng)辦理相應(yīng)經(jīng)營資格的注銷手續(xù),新經(jīng)營單位應(yīng)重新申辦成品油經(jīng)營資格。 對(duì)因城市規(guī)劃調(diào)整、道路拓寬等原因需拆遷的成品油零售企業(yè),經(jīng)企業(yè)所在地省級(jí)人民政府商務(wù)主管部門同意,可適當(dāng)延長歇業(yè)時(shí)間。 成品油零售企業(yè)不得為不具有成品油批發(fā)經(jīng)營資格的企業(yè)代銷成品油。 (一) 隱瞞真實(shí)情況的; (二) 提供虛假材料的; (三) 違反有關(guān)政策和申請程序,情節(jié)嚴(yán)重的。s governments) shall take responsibility to formulate the development planning of the fueling stations and storage industry under their respective jurisdictions, and organize and coordinate the supervision and administration of the refined oil business activities under their respective jurisdictions.
