【正文】 之一的,由勞動(dòng)行政部門責(zé)令限期支付勞動(dòng)報(bào)酬、加班費(fèi)或者經(jīng)濟(jì)補(bǔ)償;逾期不支付的,責(zé)令用人單位按應(yīng)付金額百分之五十以上百分之一百以下的標(biāo)準(zhǔn)向勞動(dòng)者加付賠償金:??( 4)解除或者終止勞動(dòng)合同,未依照本法規(guī)定向勞動(dòng)者支付經(jīng)濟(jì)補(bǔ)償?shù)摹?因此 ,《補(bǔ)償辦法》在觀念上應(yīng)該還屬于現(xiàn)行有效的 規(guī)章 , 只是在適用時(shí),相同的事項(xiàng)上有完全不同甚至相反的規(guī)定,就應(yīng)該適用《勞動(dòng)合同法》的相關(guān)規(guī)定。但兩者 對(duì)賠償金做了不同的規(guī)定:《 補(bǔ)償辦法》規(guī)定給予勞動(dòng)者 25%的經(jīng)濟(jì)補(bǔ)償金或 50%的額外經(jīng)濟(jì)補(bǔ)償金,而《勞動(dòng)合同法》第 85條規(guī)定給予應(yīng)付金額 50%以上 100%以下的賠償金。 同時(shí) ,在協(xié)議解除和勞動(dòng)合同終止的情況下也適用。賠償金一般 分為補(bǔ)償性損害賠償和懲罰性損害賠償。因用人單位破產(chǎn)或者被吊銷營業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者用人單位決定提前解散的,用人單位應(yīng)當(dāng)支付經(jīng)濟(jì)補(bǔ)償金; (3)完成一定工作任務(wù)為期限的勞動(dòng)合同終止 時(shí) 的經(jīng)濟(jì)補(bǔ)償金。 因此, 本次立法 規(guī)定 , 合同終止也要支付經(jīng)濟(jì)補(bǔ)償金, 這 起到了鼓勵(lì)企業(yè)簽訂無固定期限勞動(dòng)合同的作用。 二、 勞動(dòng)合同終止時(shí)經(jīng)濟(jì)補(bǔ)償 金 的適用 《勞動(dòng)合同法》突破了《勞動(dòng)法》中經(jīng)濟(jì)補(bǔ)償金只有在合同解除時(shí)才支付的規(guī)定,第一次規(guī)定了勞動(dòng)合同終止時(shí)的經(jīng)濟(jì)補(bǔ)償金。因?yàn)樵诜▏?,與用人單位簽訂短期固定期限合同的勞動(dòng)者人數(shù)很少,期限較短,補(bǔ)償金額不高,因此企業(yè)并沒有承擔(dān)過重的經(jīng)濟(jì)負(fù)擔(dān)。從一開始, 我國的 勞動(dòng)合同 制度就忽略了無固定期限合同所體現(xiàn)的社會(huì)法理念和對(duì)勞動(dòng)者權(quán)益保護(hù)的價(jià)值所 在。如果用人單位不想繼續(xù)錄用此勞動(dòng) 者就必須給予勞動(dòng)者經(jīng)濟(jì)補(bǔ)償,這樣就可以制約用人單位把勞動(dòng)者的青春榨干了,不付任何成本,再去找新的廉價(jià)勞動(dòng)力 , 同時(shí)讓勞動(dòng)者有所補(bǔ)償,維持穩(wěn) 定和長期的勞動(dòng)關(guān) 系。 因此, 筆者認(rèn)為,經(jīng)濟(jì)補(bǔ)償制度的 性質(zhì) 應(yīng)該體現(xiàn)以上宗旨。認(rèn)為經(jīng)濟(jì)補(bǔ)償是國家要求用人單位承擔(dān)的社會(huì)責(zé)任 ,以幫助勞動(dòng)者在失業(yè)階段維持基本生活 , 保障勞動(dòng)者的生存權(quán)。因此,經(jīng)濟(jì)補(bǔ)償?shù)臄?shù)額應(yīng)當(dāng)與在本單位的工齡掛鉤。然而經(jīng)濟(jì)補(bǔ)償制度的完善需要建立在合理 的法理上,因此,必須明確經(jīng)濟(jì)補(bǔ)償本身的性質(zhì)。 然而,許多企業(yè)則認(rèn)為,勞動(dòng)合同終止 時(shí) 的經(jīng)濟(jì)補(bǔ)償 嚴(yán)重影響了企業(yè)用人管理的自主權(quán),大大削弱了企業(yè)的競爭力,同時(shí)過度保護(hù) 容易 造成部分員工不求上進(jìn),影響企業(yè)的運(yùn)營效率 。 關(guān)鍵詞: 勞動(dòng)合同終止 經(jīng)濟(jì)補(bǔ)償金 賠償金 Abstrat With the“Labor Contract Law”and the “Implementation Regulations ”, the Economic pensation bees the focus between employers and employees. As one of the mechanisms to protect labor rights , the Economic pensation plays a positive role in protecting the legitimate rights and interests of workers . While,China’s current legislation and relevant judicial interpretation is plagued with problems . At the same time,there is quite significant differences in theory and judicial circles to understand the nature of the Economic more indepth understanding of the legal system,the article starts from the anal ysis of the Economic pensation system’s basic it ascertains the nature of the Economic Compensation system and trys to repositioning of he system aims to summarize the real causes of problems in the rther , the article explores the applications of the Economic pensation in C hina when the labor contract puts over .
