This Agreement for Ship Pollution Response (hereinafter referred to as “this Agreement”) is formulated in accordance with the provisions of Article 29 of the Regulations of the People’s Republic of China on Emergency Preparedness and Response on Marine Environment Pollution from Ships for the purpose of effectively implementing the regime of agreement for ship pollution response. 二、船舶所有人、船舶管理人或者船舶的實(shí)際經(jīng)營人(甲方)與取得相應(yīng)資質(zhì)的船舶污染清除單位(乙方),應(yīng)當(dāng)根據(jù)《中華人民共和國防治船舶污染海洋環(huán)境管理?xiàng)l例》第三十三條以及《中華人民共和國船舶污染海洋環(huán)境應(yīng)急防備和應(yīng)急處置管理規(guī)定》、《中華人民共和國海事局船舶污染清除協(xié)議管理制度實(shí)施細(xì)則》的有關(guān)規(guī)定,在船舶作業(yè)前或者進(jìn)出港口前簽訂船舶污染清除協(xié)議。 2. The owner, manager or actual operator of a ship (Party A) shall, prior to ship’s operation or entering into or leaving from a port, conclude this Agreement with a qualified ship pollution response anization (Party B) in accordance with Article 33 of the Regulations of the People’s Republic of China on Administration of the Prevention and Control of Marine Environment Pollution from Ships, relevant provisions of the Regulations of the People’s Republic of China on Emergency Preparedness and Response on Marine Environment Pollution from Ships and relevant provisions of the Detailed Rules of Maritime Safety Administration of the People’s Republic of China on the Implementation of the Administration Regime of Agreement for Ship Pollution Response. 3 三、本協(xié)議中的權(quán)利義務(wù)條款為強(qiáng)制性條款,協(xié)議雙方不得更改其內(nèi)容。本協(xié)議未盡事項(xiàng),協(xié)議雙方可另行補(bǔ)充約定,但不得違反國家有關(guān)法律、法規(guī)、規(guī)章規(guī)定以及本協(xié)議中甲乙雙方的基本權(quán)利義務(wù)的 約定。本協(xié)議的簽訂不得影響甲乙雙方根據(jù)有關(guān)法律、法規(guī)和規(guī)章的規(guī)定所享有的包括責(zé)任限制等在內(nèi)的權(quán)利以及應(yīng)承擔(dān)的義務(wù)。 3. The articles on rights and obligations of this Agreement are mandatory and both parties shall not change the contents of these articles. For matters not covered in this Agreement, the parties may reach a separate supplementary agreement. In no case should such supplementary agreement violate relevant provisions of laws, regulations and rules as well as stipulations in this Agreement concerning both parties’ fundamental rights and obligations. The conclusion of this Agreement shall not prejudice the rights and obligations that shall be enjoyed or borne by both parties in accordance with relevant laws, regulations and rules, including the right of limitation of liability. 四、對(duì)協(xié)議文本中括號(hào)中需要選擇的內(nèi)容以及空格部位需要填寫的內(nèi)容,雙方應(yīng)當(dāng)協(xié)商確定。對(duì)于雙方選擇的,在中括號(hào)以劃 √方式選定,或者在空格中填寫;對(duì)于雙方不選擇的,應(yīng)在中括號(hào)或空格部位打 ,以示刪除。 4. Choices of options with square brackets and the contents to be filled in blank spaces shall be determined by both parties through negotiation. As for the choices, options shall be chosen by marking a “√” in the square brackets, or filling in the blank spaces. With respect to those that both parties do not apply or choose, a “” shall be marked in the square brackets or in blank spaces, indicating deletion. 五、協(xié)議采用 14位數(shù)字編號(hào)(如 011001XXXX0001),其中,前兩位表示直屬海事局代碼,第 3位表示船舶污染清除單位資質(zhì)等級(jí),分別用 4對(duì)應(yīng)一、二、三、四級(jí)船舶污染清除單位的資質(zhì),第 4至 6位表示船舶污染清 4 除單位代碼,由各直屬海事局確定,第 7至 10位表示簽訂協(xié)議的年份,第 11至 14位表示協(xié)議序號(hào),由各船舶污染清除單位確定。 各直屬海事局代碼分別為:遼寧局 01,天津局 02,河北局 03,山東局 04,江蘇局 05,福建局 06,上海局 07,浙江局 08,廣東局 09,深圳局 10,廣西局 11,海南局 12。 5. The Agreement adopts fourteen numbers as its serial number (such as 011001XXXX0001), amongst which the first two numbers represent the code of a MSA directly under the China MSA。 the third number represents the qualification level of the ship pollution response anization, 1, 2, 3 and 4 respectively represents level1, level2, level3 and level4。 the fourth to sixth number represents the code of the ship pollution response anization and shall be determined by the MSA directly under the China MSA。 the seventh to tenth represents the year in which the Agreement is concluded。 the eleventh to the fourteenth represents the sequence number of the Agreement and shall be determined by the ship pollution response anization.
