Party A will handle the monthly formalities of paying individual ine tax from Party B?s salary in accordance with the related tax laws of the People?s Republic of China. 第十三條 每月 5 日為甲方發(fā)薪日,發(fā)放上月工資,如因不可抗力等特殊原因可以延遲支付(最遲不超過(guò) 5 個(gè)工作日),但必須及時(shí)向乙方說(shuō)明。 Article13 Party A pays Party B?s wage monthly on the 5th of the following month. The payment can be delayed at most 5 working days under special circumstance such as force majeure events. However, Party A must inform Party B in time. 五 、 勞動(dòng)保險(xiǎn) 和 福利待遇 5. Labor Insurance and Welfare 第十四條 甲方為乙方提供商業(yè)保險(xiǎn),詳見(jiàn)公司相關(guān)政策制度。 Article14 Party A shall provide mercial insurance to Party B, for details, please refer to the related rules and regulations of the pany. 第十五條 乙方患病或非因工負(fù)傷,在合同期內(nèi),需要停工醫(yī)療的,按國(guó)家和當(dāng)?shù)叵嚓P(guān)規(guī)定,給予相應(yīng)的醫(yī)療期。乙方在醫(yī)療期的工資待遇、醫(yī)療費(fèi)用等按照國(guó)家和當(dāng)?shù)赜嘘P(guān)規(guī)定執(zhí)行。 Article15 During the period of the contract, if Party B needs to stop working for medical treatment when he/she falls ill or is injured for a nonworkrelated reason, Party A shall provide Party B the medical period according to relevant national and local regulations. Remuneration during the medical period shall be in accordance with the national/local relevant regulations. 第十六條 乙方在患職業(yè)病或因工負(fù)傷后的工資和醫(yī)療保險(xiǎn)待遇按國(guó)家和當(dāng)?shù)赜嘘P(guān)規(guī)定執(zhí)行。 Article16 In case that Party B gets occupational disease or workrelated injuries, remuneration and medical insurance shall be executed in accordance with the national/local relevant regulation. 第十七條 其他福利待遇詳見(jiàn)《員工手冊(cè)》或公司相關(guān)政策制度。 Article17 Party B?s other welfare can refer to “Staff Handbook” and related rules and 6 regulations of the pany. 六、 勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù) 6. Labor Protection, Working Conditions and Occupational Injuries Protection 第十八條 甲方應(yīng)根據(jù)國(guó)家規(guī)定和乙方崗位的需要,為乙方提供必要的勞動(dòng)條件和勞動(dòng)工具及良好的工作環(huán)境和勞動(dòng)保護(hù)設(shè)施。 Article18 Party A shall provide Party B a safe and healthy working environment and working conditions which are equipped with necessary production facilities for ensuring the safety of Party B according to the national relevant regulations and position needs. 第十九條 甲方按照國(guó)家或當(dāng)?shù)叵嚓P(guān)部門(mén)的規(guī)定組織安排乙方進(jìn)行健康檢查。 Article19 Party A shall arrange Party B to have healthy examination according to the national/local relevant regulations. 第二十條 乙方在勞動(dòng)過(guò)程中必須嚴(yán)格遵守安全操作規(guī)程。乙方對(duì)甲方管理人員違章指揮、強(qiáng)令冒險(xiǎn)作業(yè),有權(quán)拒絕執(zhí)行;對(duì)危害生命安全和身體健康的行為,有權(quán)提出批評(píng)、檢舉和控告。 Article20 Party B must strictly ply with all safety operation rules during work process. Party B is entitled to refuse mands which violate the safety operation rules, as well as to criticize and impeach about the action which is harmful to safety and health. 第二十一條 甲方應(yīng)按《女職工勞動(dòng)保護(hù)規(guī)定》、《女職工禁忌勞動(dòng)范圍的規(guī)定》和《未成年工勞動(dòng)保護(hù)規(guī)定》,對(duì)女職工和未成年工實(shí)行特殊勞動(dòng)保護(hù)。 Article21 Party A shall implement special labor protection to women staff and minor staff according to relevant regulations including “Provisions of Female Labor Protection”, “Provisions of Scope of Female Labor Taboo”, “Provisions of Minor Labor Protection”. 七、 勞動(dòng)紀(jì)律 7. Labor Disciplines 第二十二條 甲方根據(jù)經(jīng)營(yíng)需要,依法制定規(guī)章制度和勞動(dòng)紀(jì)律。乙方違反甲方的勞動(dòng)紀(jì)律和規(guī)章制度,甲方有權(quán)根據(jù)規(guī)章制度進(jìn)行處理,直至解除本合同。 Article22 Party A shall make the pany bylaws according to relevant laws and regulations and give rewards to or take disciplinary actions against Party B according to such bylaws until the dissolution of contract. 7 第二十三條 乙方應(yīng)遵守甲方的規(guī)章制度;愛(ài)護(hù)甲方的財(cái)產(chǎn),遵守職業(yè)道德;積極參加甲方組織的培訓(xùn),提高自身素質(zhì)。 Article23 Party B must ply with all rules and regulations made by Party A, treasure Party A?s belongings,ply with occupational morality, and actively take part in training to improve diathesis by self. 第二十四條 未經(jīng)甲方事先同意 , 在本合同有效期內(nèi) , 乙方不得以任何形式在其他單位兼任任何有償工作。 Article24 During the term of this contract, Party B can not take any paid parttime job in other employer without Party A?s approval in advance. 第二十五條 甲方為乙方配備的辦公、通訊設(shè)備、交通工具及其他用品,在任何時(shí)間均歸甲方所有,乙方不得擅自處理。 Article25 At any time, all the facilitate which are prepared for Party B by Party A, such as office facilitate, munication facilitate, traffic facilitate, etc, belongs to Party A, and shall not be disposed by Party B. 八、 勞動(dòng)合同的變更、解除、終止及續(xù)訂 8. Change, Termination, Renewal and Cancellation of the Labor Contract 第二十六條 訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無(wú)法履行的,經(jīng)雙方協(xié)商同意,可以變更本合同相關(guān)內(nèi)容。 Article26 When changes have occurred in objective circumstances upon which this contract is entered into, rendering the original labor contract impossible to implement, both parties may amend relevant clauses of this contract. 第二十七條 經(jīng)甲、乙雙方協(xié)商一致,可以解除本合同。 Article27 This contract could be ended after negotiation between Party A and Party B . 第二十八條 乙方有下列情形之一的,甲方可以隨時(shí)解除本合同,且乙方無(wú)權(quán)得到任何經(jīng)濟(jì)補(bǔ)償: Article28 Under any of the following circumstance of Party B, Party A can cancel this contract at any time without any pensation: 在試用期內(nèi)被證明不符合錄用條件的。所謂試用期不符合錄用條件包括但不限于乙方體檢結(jié)果不適合崗位要求、乙方的用工手續(xù)不完備、乙方不能勝任所擔(dān) 8 任崗位的指標(biāo)或者相應(yīng)的要求、乙方不能通過(guò)甲方進(jìn)行的背景調(diào)查或者在履歷中有弄虛作假行為; 1.
